And it is hereby further enafled. That from and after the faid firfi: Day of ^z-'w one thoufand feven hundred and forty-eight, when any Tea is entered for Exportation to Ireland, or any of his Majefty's Plantations in America, the Outfide Paclcage in which it is contained, fhall, by the Searcher or Searchers belonging to the Cuftoms at the Port from whence the fame is intended to be exported, after the Entry. thereof, and before the fame is {hipped, be marked on four different Parts, on the Outfide thereof, in fuch Manner as the Commiffioners of the Cuftoms fhall direftj and if any Cheft, CafrC, Tub, or other Pack-l age, fhall, after the fame has been marked and fliipt as aforefaid, be landed, or found again on Shore, having _ fuch Marks thereon, fuch Cheft, Cafk, Tub, or other Package, with the Tea therein contained, fhall bej forfeited and loft, and fhall and may be feized and profecuted by any Officer or Officers of the Cuiloms 01 Inland Duties, in fuch Manner as herein after is expreffed. IV. And, for preventing the clandeftine Delivering of Tea out of the Warehoufes herein before-men- tioned, in order for the Exportation thereof to the Kingdom of Ireland, or to his Majefty's Plantations iril America ; Be it enafted by the Authority aforefaid, That the Keeper or Keepers of the faid Warehoufe or | Warehoufes, who fliall be appointed by the Commiffioners of his Majefty's Cuftoms and Inland Duties, fliall keep one or more Book or Books, wherein they fhall fairly enter in Writing, an exadl:, particular and , true Account of all fuch Tea which fhall, from time to time, be delivered out of the faid XVarehoufe or| Warehoufes for Exportation to Ireland, or the Plantations in America, and the Names of the refpeftive Per-- fon or Perfons to whom, or for whofe Ufe, the fame was delivered out, and the particular Days and TimesI when the fame was fo delivered out; and fhall, at the End of every three Months, or oftener if required,* tranfmit in Writing an Account thereof, upon Oath, to the faid Comm.iffioners of the Cuftoms and Inland Duties refpeftively for the time being ; and the faid Commiffioners are hereby required and enjoined, with- in one Month after the fame fhall have been tranfmitted to them, as aforefaid, to appoint one or more Per- fon or Perfons to infpect and examine the fame A^ccounts ; and if, upon Examination, it fhall appear thati any Tea has been delivered out for Exportation to Ireland, ox the Plantations, otherwife than and under fuch Terms, Eorms and Conditions performed as herein are before direfted, appointed and required for the doing thereof; then the Warehoufe-keeper and Warehoufe-kcepers oiTending therein fhall not only be difabled to hold or enjoy any publick Office or Employment, but fnall alio forfeit and lofe for every fuch, Oflence the Sum of one hundred Pounds. V. And be it further enafted by the Authority aforefaid, 1 hat one Moiety of the feveral Penalties and"! Forfeitures in this K£t before-mentioned fnall be to the Ufe of his Majefty, his Heirs and Succeilbrs, and! the other Moiety fhall be to the Ufe of fuch Perfon or Perfons as fhall inform, profecute or fue for the fame j (except in fuch Cafes v/here any other Appropriation or Diflribution is made by any other Acl or Acls)l and that all the fains Penalties and Forfeitures fliall and may be profecuted and fued for, and the Caufesi and Controverfies arifing thereupon tried, heard and determined in any of his Majefty's Courts of Record atl JVeJhninfier, or in the Cou^t oi Exchequer sA Edinburgh refpeclively (except where any Provifion to the! contrary is made by any other Law or Statute now in Force) wherein no EfToin, Protection, Wager ofl Law, or more than one Imparlance, fliall be allowed. VI. And be it further enafled by the Authority aforefaid.
