An Ad to impower his Majefty to prohibit the Exportation of Salt Petre ; and to enforce the Law for impowering his Majefty to prohibit the Exportation of Gunpowder, or any Sort of Arms and Ammunition -, and alfo to impower his Majefty to r^ftrain the carrying Coaftwife of Salt Petre, Gunpowder, or any Sort of Arms or Ammunition. ' ' "T7HEREAS by an A(5l of Tonnage and Poundage made in the twelfth Year of the Reign of ' VV King Charles the Second, Power is exprefly referved to his Majefty to prohibit, at and for ' fuch Times as he fhould fee Caufe, the tranfporting of Gunpowder, or any Sort of Arms or Ammunj- ' tion, into any Parts out of this Kingdom : And whereas Salt Petre is abfolutely neceflary to the making ' of Gunpowder, and the publick Safety may require temporary Reftraints upon the Exportation there- ' of, at critical Conjundures ;' Therefore to prevent all Dobuts, be it hereby declared and enafled by the King's moft Excellent Majefty, by and with the Advice and Confent of tlie Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame. That his Majefty may, by Proclamation or Order in Council, when he ft^all fee Caufe, and for fuch Time as (hall be therein exprefltd, prohibit the exporting, or attempting to export. Salt Petre out of this Kingdom, in fuch Manner and under fuch Reftraints as he fliall think fit. II. And it is hereby further enadled. That whatever Quantity or Quantities of Salt Petre, Gun- powder, or any Sort of Arms or Ammunition prohibited by Proclamation or Order in Council to be exported, (hall be fhipped or laden on Board any Ship or VelTel in any of the Port or Ports of Gre<;t Britain, in order for Exportation, contrary to fuch Proclamation or Order,^ all fuch Salt Petre, Gun- powder, or any Sort of Arms or Ammunition, prohibited by Proclamation or Order in Council to be exported, (hall be forfeited, and may be feized by Warrant from any Magiftrate, or by any Cuftom- houfe, Impoft, or Excife Officer ; and the Owner or Owners of fuch Salt Petre, Gunpowder, or any Sort of Arms or Ammunition prohibited by Proclamation or Order in Council to be exported,, as ftiall be lb (hipped for Exportation, fhall feverally and refpe6tively forfeit and pay the Sum of one hundred Pounds for every Hundred Weight of Salt Petre and Gunpowder, and fo in Proportion for any lefter Qviantity ; and one hundred Pounds for every five and twenty Arms, and fo in Proportion for any greater or lelTcr Number ; and one hundred Pounds for every two hundred Weight of any Species of; Ammu- nition, and fo in Proportion for any lefTer Quantity, prohibited by Proclamation or Order in. Couhtjl to be exported, fo fliipped for Exportation. III. And be it further enadted. That if any Perfon or Perfons (hall be aiding or affifting in the fhlp- ping or lading any Salt Petre, Gunpowder, or any fort of Arms or Ammunition for Exportation, du- ring the Time it (hall be fo prohibited by Proclamation or Order in Council, contrary to fuch Proclama- tion or Order, every fuch Perfon fliall forfeit and pay one hundred Pounds, and treble the Value of fuch Salt Petre, Gunpowder, or any fort of Arms or Ammunition prohibited by Proclamation or Or- der in Council to be exported. IV. Provided alfo, and be it hereby further enafted, That if any Mafter of any Ship or VelTel (hall lade or take on Board, or fuffer or permit to be laden or taken on Board, any Salt Petre, Gunpowder, or any fort of Arms or Ammunition for Exportation, during the Time it (hall be fo prohibited to be exported as aforefaid, every fuch Mafter fliall forfeit the Sum of one hundred Pounds. V. Provided always, and be it further enadted by the Authority aforefaid. That this A<5V, and every Claufe, Matter and Thing herein contained, fliall extend, and be conftrued to extend, to impower his Majefty to prohibit the (hipping of any Salt Petre, Gunpowder, or any fort of Arms or Ammunition^ in order to be carried Coaftwife, in like Manner as he is by this A61 impowered to prohibit the Exporta- tion of Salt Petre. VI. And it is hereby further enabled. That the Penalties before in this A6t mentioned and provided, (hall be divided into three feveral Parts, two third Parts thereof to his Majefty, his Heirs and Succef- fors, and the other third Part thereof to fuch Perfon or Perfons as (hall feize or fue for the fame, by Bill, Plaint or Information, in any of his Majefty's Courts of Exchequer in Great Britain, wherein no EfToin, Protection, or Wager of Law, (hall be allowed, CAP. XVII. An Aft to prevent his Majefty's Subjefts from ferving as Officers under the French King ; and for the better enforcing an Aft paffed in the ninth Year of his prefent Majefty's Reign, to prevent the inlifting his Majefty's Subjefts to ferve as Soldiers without his Majefty's Li- cence ; and for obliging fuch of his Majefty's Subjefts as ftiall accept CommilTions in the Scoich Brigade, in the Service of the States General of the United Provinces, to take the Oaths of Allegiance and Abjuration.
