D. 1757; ' Time and Times as they, or any five or more of them refpe£lively fhall think fit ; and fuch refpe£live CommifTioners, or any five ^r more of them, may alfo meet at fuch other Time and Times, as any five or more of them refpectively {hall think neceflary to appoint, by Notice in Writing under their Hands, to be affixed on March Bridge, in refpeft to all fuch Meetings as fhall be fo fummoned for the firfl, third, fifth and fixth Diftrifts, and the faid fourth Diftriit ; and upon March and Upvuell Bridges for all fuch Meetings as fhall be fo fummoned for the faid fecond Diftrift, feven Days at the leaft before the holding any fuch Meeting refpe£tively ; and the faid refpeilive Commiffioners, at all the Meetings to be held by virtue of this Aci, fhall defray their ovi^n Expences. Where to be ■^^- Provided always, That all the General Meetings, and all the Meetings which fhall be held by held. Adjournment, or fhall be fummoned in Manner as aforefaid, for the firflr, third, fifth and fixth Diftrifts, and alfo for the faid fourth Diftrict, fhall be held at fuch convenient Place or Places in the faid Town of Jllarch, as the Commiffioners, or the major Part of them, aflembled at the previous Meetingwhich fhall be held by Adjournment, (hall appoint, or as fhall be fpecified in the Notice for fummoning fuch Meet- ings refpectively, and not elfewhere ; and that in like Manner, every third Meeting for the faid fecond Diftrict fliall be held at the Town of Upwcll; and the other Meetings for fuch Diilrict at the faid Town of Alcirch, and not elfewhere. Commiflioners XII. And be it further enacted by the Authority aforefaid. That the refpective Commiffioners for the to make and faid Diftricts, or any five or more of fuch Commiffioners, aliembled at all or any of their Meetings to be niaintainWorks; ^^jj j^y virtue of this Act, fhall be and are hereby fully impowered, from time to time to make, fupport, alter and maintain, or caufe to be made, fupported, altered or maintained, fuch Cuts, Drains, Dams, Banks, Tunnels, Headings, Trays, Stamps, Outlets, Works and Engines, in, through and upon ths faid Fen Lands, Low Grounds and Commons, or any Part thereof, in fuch refpective Diftricts ; and to make, erect, remove, alter, repair and maintain all fuch Works and Engines thereupon j and if any Works or Engines are already made or erected in fuch Diftricts, to remove, alter, repair, or continue the fame, in fuch Manner as they the faid refpective Commiffioners, or any five or more of them, fhall from time to time think neceflary or convenient for draining and preferving the faid Lands, Grounds and Commons ; and alfo to make fuch Orders, and give fuch Diredtions for carrying on, and for the better and more orderly Government of the faid Works, and for executing the Purpofes of this A£t, within and in relation to fuch refpedlive Diftri(SI:s, as they the faid refpective Commiffioners, or any five or more of them (hall think proper ; making fuch reafonable Satisfaction to the Perfon or Perfons who hath or have a Right to the Soil through or upon which any fuch Cut, Drain, Dam, Bank, Tunnel, Heading, Tray, Stamp, Outlet, Work or Engine, fliall be made and ere^led, for the Damages he, (he or they fhall thereby fuftain, as fliall be agreed upon between fuch refpeitive Commiffioners ; or any five or more of them, and the Perfon or Perfons having fuch Right as aforefaid j and if fuch refpe6tive Commiffioners, or any five or more of them, and fuch Perfon or Perfons, cannot agree touching the Amount of fuch Da- mage, that then the fame (hall be aflefled, adjudged, and finally determined, by the Juftices of the Peace, or the major Part of them aflembled at any General or Qviarter-Seffion of the Peace, which fhall be held making Satisfac- for the faid IJle of Ely, within fix Months after fuch Difpute fhall arife ; and in cafe fuch Owner or
- '°°' Owners fhall make Oath, that in his, her or their Opinion or Judgment, fuch Damage amounts to above
the Value of forty Shillings, the Juftices at fuch Seffions {hall, and they are hereby authorized and re- quired to charge the Jury, which fhall attend at fuch Seffion, or fome other Jury of twelve honeft and indifterent Men (to be then and there impanelled and returned by the Chief Bailiff of the faid IJle of Ely, without Fee or Reward) and caufe them to be fworn well and truly, on their Oaths, to afTefs the Re- compcnce to be made for fuch Damage, which Oath the faid Juftices are hereby impowered and required to adminifter to the faid Juries j and to which faid Juries the faid refpedtive Commiffioners, and the Par- ties complaining, fhall have their lawful Challenges ; and the faid Jury being fo charged and fworn as aforefaid, and after proper Evidence, upon Oath, to them given, of the Nature of fuch Damage, fhall by their Verdict, alTefs the Damages and Recompence to be made for the fame, to fuch Owner or Owners ; and the V^erdift of the Jury, and the Judgment of the faid Juftices thereupon, Ihall be final and con- clufive to all Parties. Oificerj to be XIII. And be it enabled by the Authority aforefaid. That the faid refpeftive Commiffioners, or any nppoiDicd. five or more of them, aflembled at all or any of the Meetings to be held in purfuance of this A6t, fhall be and are hereby refpeclively impowered to appoint fuch Colledlor or Collecflors, Receiver or Receivers, and fuch other proper Officer or Officers, for each of the faid feveral Diftridts, as they the faid re- fpective Commiffioners, or any five or more of them, fhall think fit, for the taking Care of all fuch Works, and for collecting the Taxes or AflefTments which fhall be made, rated or alTefl'ed, in each of the faid feveral Diftrifls ; and to allow to fuch Officers, out of fuch Taxes or AflefTments, fuch yearly or . other Wages or Salaries for their Trouble and Pains in their refpeitive Offices, as they the faid refpeftive Corrmiffioners, or any five or more of them, prcfent at any fuch Meeting, fhall think reafonable ; which faid Collector or Collcdtors, Receiver or Receivers, and other Officer or Officers, fo to be appointed, may be altered and removed at the Will and Pleafure of the faid refpe6tive Commiffioners, or any five or trore of then^, aflembled at a Meeting to be held for that Purpofe, of which fourteen Days Notice fhall h^ given in V'riting, to be 7ii^xti on March Bridge, and another or others appointed in his or their Room or Stead, as Occafion {hall recjuire •, and fuch Colle6tors or Receivers {hall, before they a6l in the Execution of their refpedlive Offices, give fuch Security, if the fame {hall be required, for the due Execution of fuch refpedlive Offices, and for performing the fovcral Trufts to them com- mitted.
