Provided alfo, and be it further enacSled by the Authority aforefaid, That this A6i fhall not extend to impower the Coniiriifiioners for the faid fourth Diflricl to make a Drain through the Lands now belonging to CharLs Btozvn^ and in the Occupation of Nicholas Eldridge^ in any other R'lanner than by one End and one Side of fuch Lands j that is to fay. To begin at the Corner be- tween "James Boyce and the aforefaid Charles Brown s Lands, and fo on between the Lands of Mifs Hakes and the iaid Charles Brovjn to the River Nene j or to begin at the aforefaid Corner, and fo on by the Comnv.n Drove to the Pla7it Water Bank, and from thence by the Lands of the faid Charles Brown to the faid Rivtr Nene and that fuch Drains fliall be made only at one End and one Side of the faid Lands of the aforefaid Charles Brown, faving fuch Drains as take the Waters off the Lands of the faid Charles Brown only. XLVIIL And be it further enacSed by the Authority aforefaid, That if the Owner or Owners, Occupier or Occupiers of any Lands lying within the faid Diftricts, to which any Drove-way Dike, Outring Dike or Divifion Dike doth or fhall belong, fhall neglccSl or refufe fufficiently to rode, icour, cleanfe, open or repair any fuch Dike, or to make the fame of a fufficient Depth, and of the Width of nine Feet at the leaft, after fourteen Days Notice in Writing given to him, her or them, or left at his, her or their Place of Abode from Time to Time for that Purpofe, by the Colieftor or ColletSlors, Receiver or Receivers for the refpecSlive Diftridt where- in fuch Lands lie (fuch ColleiSlors or Receivers having an Order in Writing for that Purpofe, under the Hands of three or more of the Conimiflioners for fuch refpe£live DiltriiSls) ; every fuch Owner or Occupier fhall for every fuch Neglect or Refufal, forfeit and pay the Sum of twelve Pence for every Rod of the Dike (o neglected to be roded, fcoured, cleanfed, opened, repaired, depthened and widened ; and it fhall be lawful from Time to Time for fuch Collector or Col- lectors, Receiver or Receivers, to caufe fuch Dikes at the Charge and Expence of fuch Owners or Occupiers, to be roded, fcoured, cleanfed, opened, repaired and depthened in a fufficient Man- ner, and made of the Width aforefaid at the leaft ; and where a Way fhall have been made over any Dike without a fufficient Tunnel, to caufe fuch Ways to be taken up, and fuch Dike to be made of a proper Width and Depth ; and by Warrant or Precept under the Hands of three or more of the Commiffioners for the refpedlive Diftrifts to levy fuch Penalty, and alfo fuch Charges and Expences upon fuch Owner or Owners, Occupier or Occupiers, by Diftrefs and Sale of his, her or their Goods and Chattels, and fuch Penalties (hall be applied to the Ufe of the Diftrift wherein fuch Lands fhall be fituate.
