And be it enacted "by the Authority aforefaid, That if any High Conftable or Petty Conilable Oiall Pensitv on Con. wilfully negle£l or refufe to execute any fuch Warrant of the faid Juftice or Juflices of the Peace, as fliall be direded unto fuch Conftable or Petty Conftable for providing Carnages as aforefaid ; or if any Perfoii or Perfons, appointed by fuch Conftable or Petty Conftable to provide or furnifti any Carriage and Man, fliall refufe or neglect to provide the fame ; or any other Perfon or Perfons whatfoever fhall wilfully do any A(ft or Thing, whereby the Execution of any fuch Warrant or Warrants fhall be hindered or fruftrated ; every fuch Conftable, or other Perfon or Perfons fo offending, fhall, for every fuch Offence, forfeit any Sum not exceeding forty Shillings, nor lefs than twenty Shillings, to the Ufe of the Poor of the Parifti where any fuch Offence ftaall be committed : And all and every fuch Offence and Offences fhall and may be enquired of, heard, and fully determined, by two of his Majefty's Juftices of the Peace, dwelling in or near the Place where fuch Offence (ball be committed, who have hereby Power to caufe the faid Penalty to be levied by Diftrefs and Sale of the Offender's Goods and Chatties, rendering the Overplus (if any) to the Owner. ' XXVII. And whereas the refpe6live Sums of Money by this Aft appointed to be paid to the Conftable ' by the Officers demanding fuch Carriages, may not, in many Cafes, be fufficient to anfwer the Charge ' and Expence of providing the fame, whereby the faid Conftables may be frequently at great Charges, over ' and above what is received by them of the faid Officers, to the great Burthen of the Townfhip of which

To prevent which, and that fuch Overplus Charge may be borne by each County or Riding at the general Charge of fuch County or Riding, Be it further ena6ted by the^Authority aforefaid. XXVIII. A-nd in cafe the faid publick Stock of the County or Riding be not fufficient (over and above the other Purpofes for which it was raifed) tofatisfy the extraordinary Charge of Carriages before-mentioned ; it is hereby further enafted. XXIX. Provided always, and be it further enafted. That the Carriages for the Service of the Marine Forces quartered or Carriages in marching in Scotland, fhall be provided in like Manner, and at the Rates, and the Furniftier of fuch Car- Scotland how t» riages fhall be paid, as was direfted by the Law in Force in Scotland at the Time of Union, with regard to ^^ prouded. the furnifhing Carriages for Land Forces. XXXI. And be it enafted by the Authority aforefaid. That if any Officer, Military or Civil, by this Marines Wive?. XXXII. And for the better Prefervation of the Game, in or near fuch Place where any Officers or Sol- Penalty on Of- diers fhall at any 7^ime be quartered ; Be it enafted by the Authority aforefaid. That if, from and after the fi«rs or Ma- faid twenty- fifth Day of Jw<';rt7; one thoufand feven hundred and fifty-eight, any Officer or Marine fhall, '■'"^-<^"'"°>^S without Leave of the Lord of the Manor, under his Hand and Seal firft had and obtained, take, kill or de- '^'^ G^'tne- ftroy any Hare, Coney, Pheafant, Partridge, Pieeon, or any other Sort of Fowls, Poultry or FiHi, or his Majefty's Game, within the Kingdom of Gj-eat Britain ; and upon Complaint thereof fhall be, upon Oath of one or more credible Witnefs or Witnefl'es, convii^ted before any Juftice or Juftices of the Peace, who is and are hereby impowered and authorized to hear and determine the fame ; (that is to fay) every Officer io offcndfng fhall, for every fuch Offence, forfeit the Sum of five Pounds, to be diftributed among the Poor of the Place where tiie Oftence fhall be committed ; and every Officer commanding in Chief upon the Place, for every fuch Offence committed by any Marine under his Command, fhall forfeit the Sum of twenty Shil- lings, to be paid and diftributed in Manner afoiefaid : And if, upon Conviftion m.ade by the Juftices of the Peace, and Dem.am' thereof alfo made by the Conftable or Overfeers of the Poor, fuch Officer fnall re- fufe ornegleft, and not within two Days pay the faid refpeftive Penalties, fuch Officer fo refufing or ne- glefting fhall forfeit, and is hereby declared to have forfeited his Commiffion, and his Commiffion is hereby declared to be null and void.
