D. 1757. a Certificate that fuch Perfon is the Wife, Father or Mother of fuch Officer or Seaman refpeclively, under the Flands of the Minifrer and Churchwardens, or, in Scotland^ of the Minifter and two Elder?, of the Pa- nlh where fuch Perfon was married, or rcfides ; fuch Receiver, Colledor, or Clerk of the Checfuc, upon being fatisfied of the Truth of fuch Certificate, is immediately, without Fee or Reward, to pay the Sum mentioned in fuch Bill, taking a Receipt. Such Bill, together with the Duplicate thereof, being produced at the Navy Office, (hall be immediately affigned for Payment by the Commiflioners of the Navy, and repaid by the Trealurer of the Navy, to fuch Receiver, Colledtor, or Clerk of the Cheque, or their Order refpec- tively ; but if Payment of the faid Bill be not demanded of fuch Receiver, Colle6lor, or Clerk of the Cheque, and the Duplicate of the faid Bill, together with a proper Certificate, be not produced and deli- vered to them refpedlively, within fix Months from the Date thereof, the Bill is to be returned and cancel- led, and the Sum contained therein is to become payable to fuch inferior Officer or Seaman when the Ship Ihall be paid. 13. In like Manner, when Wages {hall be paid at the Pay Office, or at any of the Out Ports, if any in- ferior Officer or Seaman (hall be defirous to remit the Whole or Part of his Wages to his Wife, Children, Parents, or any other Perfon, and to have a Bill for the fame drawn upon any fuch Receiver, Colle6lor or Clerk of the Cheque, two Bills are to be made out, one of which is to be delivered to fuch Officer or Sea- man, and the other to be fent to fuch Receiver, Colledor, or Clerk of the Cheque, who is to pay immedi- ately the Sum therein mentioned, without any Fee or Reward, taking a Receipt. If any fuch Receiver, Colledor, or Clerk of the Cheque, fhall not have in his Hands Money to an- fwer any Bill tendered by fuch Wife, Father or Mother, aforefaid, and fhall rcfufe or delay the immediate Payment thereof, he is immediately to indorfe on fuch Bill the Caufe of his Refufal or Delay, and appoint for Payment fome Day within two Months after fuch Tender ; and if, upon Complaint to the Commiffion- ers refpeitively appointed to manage the Land Tax, Cufloms or Excife, or to the Commiffioners of the Navy, refpeftively, it fhall appear, that any fuch Receiver, Colledlor, or Clerk of the Cheque, hath unne- ceffarily and wilfully refufed or delayed Payment, or that he, or any Perfon employed by or under him, hath taken any Fee, Reward, Gratuity, Difcount or Deduiflion, on account of Payment of any fuch Bill, fuch Commiffioners may fine fuch Offender in any Sum not exceeding fifty Pounds. 15. The Wages, Pay and Allowances, earned by any indentured Apprentice, fliall be paid to his Mafler, as hath been ufual, unlefs fuch Apprentice was above eighteen Years of Age when his Indentures were exe- cuted, or fhall be rated as a Servant to any Officer to whom fuch Apprenticefhip is not known ; in which Cafe, fuch Officer fhall be intitled to the Pay and Wages of fuch Servant, according to the ufual Pradice of the Navy, until fuch Officer fhall be informed of fuch Apprenticefhip. 16. Captains or Commanders of Ships are to tranfmit from time to time to the Commiffioners of the Navy, at their Board, complete Pay Books, Lifts and Tickets, and alfo once in every two Months complete Mulfer Books, under the Penalty of forfeiting all their Wages to the Cheft at Chatham^ and of being liable to fuch further Punifhment as a Court-martial fhall infiidl ; except in Cafes of Neceffity, to be made appear to the Satisfaction of the Lord High Admiral, or Commiffioners of the Admiralty. 17. The Tickets, Certificates, Pay Lifts and Bills, fhall be fufficient Vouchers to the Treafurer of the Navy for the Payments thereon. 18. Captains, or Commanders, ifTuing any Tickets other than fuch as as are directed by the A£t, fhall be fubjeft to a Penalty of fifty Pounds for every Ticket, and fhall forfeit all their Wages to the Cheft at Chatham. 19. No Captain, or Commander, fhall be liable to any Penalty for any Offence againft the A£t before the firfl of June one thoufand feven hundred and fifty-nine, unlefs he he hath previoufly received this Ab- ftraa. 20. No Letters of Attorney made by inferior Officers or Seamen, or their Executors or Adminiftrators, for receiving Wnges or Allowances of Money, fhall be valid, unlefs declared therein to be revocable ; and unlefs the fame, if made by any fuch Officer or Seaman then in the Service, be figned before, and attefted by, the Commander and one other of the figningOfficers of the Ship, or by a Clerk of the Cheque : And if made by any fuch Officer or Seaman after his Difcharge from the Service, unlefs the fame be figned be- fore, and attefted by, the Mayor or Chief Magiftrate of the Town or Place where fuch Officer or Seaman fhall then refide; or unkfs the Letter of Attorney, if made by fuch Executors or Adminiftrators, be figned before, and attefted by, the Miniltcrand Churchwardens, or, in Scotland, by the Minifter and two Elders, of the Parifh where fuch Executors or Adminiftrators refide. 21. All Letters of Attorney, other than fuch as are made in Manner aforefaid, and all Bargains, Sales, Bills of Sale, Contracts, Agre(?ments and Affignments, concerning Wages or Money to inferior Officers or Seamen, fhall be null and void. 22. No more than one Shilling fhall be taken by any Ecclcfiaftical Court, or other Perfon, for the Pro- bate of any Will, or Letters of Adminiftration, granted to the Widows, Children, Fathers, Mothers, Bro- thers or Sifters, of inferior Officers, Seamen or Marines, dying in the Service, and for the Pains, Trouble and Expence, attending the fame, unlefs the Goods and Chatties are of the Value of twenty Pounds ; nor more th:m two Shillings, unlefs fuch Goods and Chatties arc of the Value of forty Pounds ; nor more than three Shillings, unlels fuch Goods and Chatties are of the Value of fixty Pounds ; Nor more than one Shil- ling
