D. ly^^ mi-le good. aniwer and pay Treble Cofts of Suit to any Contributor or Perfon claiming under him that wiil fuc for the fame, to be recovered by Adion of Debt, Bill, Plaint, or Information, in any of his Majefty's Courts of Record at Wijini'mjhr^ wherein no Efibin, Protection, Privilege, or Wager of Law, InjuniSlion, or Order of Relbaint, or any more than one Imparlance fhall be granted or allowed; and in the faid Action the Plaintiff, upon Recovery, (liall have full Cofts of Suit; one third of which Sum fnall be paid into the faid Receipt of Exchequer, for the Benefit of his Majefty, his Heirs, and SuccelTors, and the other two thirds fhall be to and for the Ufe of the Profecutor. Peficicrcies of the Ex- LVII. And it is hereby enaded by the Authority aforefaid. That if at any Time or Times it rhequr, .<tc.howtobe fi;iall happen that the Produce of the faid feveral Subfidies, Rates and Duties hereby granted, for Payment of the faid feveral Annuities, fhall not be fufficicnt to pay and difcharge the I'everal and re- fpectivc Annuities and other Charges direil^d to be paid thereout, at the End of any or either of the refpective Half-yearly Days of Payment, at which the fame are hereby directed to be paid ; then, and fo often, and in every fuch Cafe, fuch Deficiency or Deficiencies fhali and may be fupplied out ot any of the Monies which at any Time or Times Ihall )i or remain in the Receipt of the Exche- quer, of the Surpluflcs, Excefles, Overplus Monies, and other Revenues, compofing the Fund commonly called The Sinking Fund (except fuch Monies of the faid Sinking Fund as are appropria- ted to any particular Ufe or Ufes, by any former Act or Atts of Parliament in that Behalf} ; and fuch Monies of the faid Sinking P'und ihall and may be, from time to time, ijTued and applied ac- cordingly ; and if at any Time or Times, before any Monies of the feveral Subfidies, Rates, and Duties hereby granted fliall be brought into the Exchequer as aforelaid, there fliall happen to be a Want of Money for paying the feveral Annuities as aforefaid, which fhall .be actually incurred and grown due at any of the Half-yearly Days of Payments before-mentioned, that then, and in every luch Cafe, the Money fo wanted, (hall and may be I'upplied out of the Monies of the Sinking Fund (except as before excepted) and be ilfued accordingly. LVIII. Provided always, and be it ena6ted by the Authority aforefaid. That whatever Monies fhall be illued out of the Sinking Fund, fhall from time to time be replaced, by and out of the firft Supplies to be then after granted in Parliament. LiX. Pro ided always, and be it enacted by the Authority aforefaid. That in cafe there fhall be any Surplus or Remainder of the Monies arifmg by the faid J'everal Subfidies, Rates, and Duties, af- ter the faid feveral and refpedtive Annuities, and all Arrears thereof, are fatisfied, or Money fuifi- cient fhall be rcfcrved for that Purpofe, fuch Overplus or Remainder fhall, from time to time be re- fcrvcd for the Difpofition of Parliament, and fhall not be ill'ued but by the Authority of Parliament, and as fhall be directed by future A£t or A6ts of Pailiament ; any thing in any former or other Aift or A<fts of Parliament to the contrary notwithftanding. LX. And it is hereby enacted by the Authority aforefaid. That if any Perfon or Perfons fhall, at any Time or Times, be fued or profecuted for any Thing by hini or them done or executed in pur- fuance of this A«5t, or of any Matter or Thing in this Adt contained, fuch Perfon or Perfons Ihall General Iffue. and may plead the General IfTue, and give the Special Matter in Evidence for his or their Defence; And if, upon Trial, a Veididt fliall pafs for the Defendant or Defendants, or the Plaintiff or Plains T:eble Cofts, tifFs fhall become nonfuited, then fuch Defendant or Defendants fhall have ireble Cofts to him or. them awarded againft fuch Plaintiff or Plaintiffs. XI. * An A6t to permit the free Importation of Cattle from Ireland for a limited Time.
- WJ H E R E A S the permitting the free Importation of Cattle into Great Britain from Ireland
- W ff>i' '<'- limited Time, may be of great Advantage to both Kingdoms ;' Be it therefore enacted
by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, Tliat from and after the firft Day o' May one thoufand feven hundred and fifty-nine, the free Importation of all Sorts of Cattle into this Kingdom from Ireland, fhall b^ and is hereby permitted, allowed, and authorized, for and during the Space of five Years from the faid firft Day of ^'I//?)', or at any Time thereafter before the End of the then next Seflion of Parliament j and that all Per- fons (hall be, and arc hereby exempted, freed, and difcharged, from the Payment of all Subfidies, ■Ciifloms, Rates, Duties, or other Impofitions, and alfo from all Penalties, Forfeitures, Payments, ,nnd ]iniflifiK-nts, for or upon account of Importing or bringing Cattle into this Kingdom from Ireland, during the Term aforefaid j any A6t or Acts of Parliament to the contrary notwith- ftanding. IT. And be it further cna£ted by the Authority aforefaid.
