In the feveral Months of ^<3?tA and Ot^ober in each Year, 2X'JitJlice Hall in the Old Bailey^ London; except at fuch Times as the Seftions of Oyer and TernAn r and Gaol Delivery for the City of London and County of Afiddlefex fliall be appointed to be there held; or in fuch other Place, within that V?it of Great Britain caUed England., as the Lord High AdmiriU of Great Britain, or the Commif- ftoners for executing the Office of Lord High Admiral of Great Britain for the Time being, or any three or more of them, ftiall by any Letter or Order in writing under their Hands diredled to the Judge of the High Court of Admiralty in England for the Time being appoint. XXI. And be it further ena61ed by the Authority aforefaid. That from and after the firft Day of June one thoufand feven hundred and fifty-nine, it fliall <.nd may be lawful, not only to and foir any one or more of the CommifTioners for the Tin-ie being, named in the Commiflion of Oyer and* Terminer for the trying of Offences committed within the jurifdij:tion of the Admiralty of Englani^ but jilfo to and for any one or more of the Juftices of the Peace for the Time being of any County,' Riding, Divifion, or Place, within that Part of Great Britain called England, and they are hereby? refpectiely authorized and impowered, from time to time, to take any Information or Informations' of any Witnefs or WitnefTes in Writing upon Oath, t,-uching any Piracy, Felony, or Robbery, done or committed, or charged to have been done or coniinittcd, in or upoii the Sea, or in any Haven, River, Creek, or Place, where the Admiral or Admirals hath or have Power, Authority, or Jurifdidion ; and thereupon (if fuch Commiftioner or Commi/Tioners, or Juftice or Juftices of the- Peace refpedivcly fhall fee Caufe) by any Warrant or Warranis under his or their Hand and Seal, or Hands and Seals, to caufe the Perfon or Perfons accufed in fuch Information or In- formations to be apprehended and committed to the Ciaol of the County or Place wherein the fame Information or Informations fhall be taken, there to remain until dilcharged by dueCourfe of Law. XXII. And it is hereby further enaded, That fuch of the f:iid CommifTioners, or Juftices of the Peace, who fhall caufe any fuch Peifon or Perfons to be committed as is iaft mentioned, fliall, and he or they is or are hereby refpedively required at the fame Time to oblige all and every fuch other Perfon or Perfons whom fuch CommifTioncr or CommifTioners, or Julti'.e or Juftices of the' Peace fhall judge neceifary to piofecute and give Evidence againft the Perfon or Perfons who fhall be fo committed as aforefaid, to enter into one or more Recognizance or Recognizances to his Majefty, in a fufficient Penalty for his, her or their appearing at the then next SefTion of C^y^r and Terminer^ and Gaol Delivery, to be held for the Jurifdidion of the Admiralty of England, there to profecute, and on Refufal, to com- and give Evidence againft the Perfon or Perfons who fhall be coumiitted as aforefaid : And if any mit them. Perfon fhall refufe to enter into fuch Recognizance to prollcute or give Evidence as fhall be requi-'l red, he, fhe or they fo refufing fhall be committed by any fuch Commiftioner or CommifTioners, Juftice or Juftices, to the Gaol of the County or Place in which th^ P rron fo refufin ', fhall be, un-J til the next ScfTions of Admiralty fhall be held, or fuch Perfons (hall enter into fuch Recognizance as' fhall be required as aforefaid; which Recognizance or Recognizances, together with the informa-J tion or Informations taken touching the Offence or Oftences wherewith the Perfon or Perfons to be committed as aforefaid fhall be charged, the faid CommifTioner or Commiflioners, or Juftice or Ju- fti es of the Peace, before whom the fame fhall be taken, fhall and they are hereby refpedively re- cjuired to tranfmit with all convenient Speed to the Rcgifler for the Time being of the High Court of h.drrx7!K.-j of England, to be by him forthwith laid before the Judge for the Time being of the fame Court, and afterwards to be kept among the Records of that Court. XXIII. And be it further enaded by the Authority aforefaid. That the Marfhal of the Admiralty for ?nd other Peace Officers, the T'ime being, and his Deputy or Deputies, and all Sherift's, Bailiffs, Stewards, Conftables, are to obey and execute Headbotoughs, Tythingmen, Keepers of Gaols and Prifons, and all other Officers whatfoever, for keeping of the Pc ;ice (as well within Liberties as without) fhall, and they, and every of them, are hereby refpedively authorized and required, from time to time, diligently to execute, perform and obey all fuch Precept and Precepts, Warrant and Warrants, and other Order and Orders, as fhall at any Time or 'limes hereafter be made, direded, iffued, or given to them or any of them refpcc- , tively, by any one or more of the faid Commiflioncrs named in the Commiflion of Oi'^r and Terminer.^' or Juftices of the Peace, by virtue or in purfuance of this Ad, touching any of the Matters or Things ' herein contained.
