D. 1759. otber than the ufual DeduiSlions for Cloathing, and twelve Pence in the Pound to be difpofed of as his Majefty fhall think fit, and the one Day's Pay in the Year for the Ufe of the Royal Hof- pital at Chelfca^ and fuch other neceilary Dedudions as fhall from time to time be dire£led by the faid Lord High Admiral, or three or more of the Commrflioners for executing the Office of Lord High Admiral for the Time being, by Order in Writing under his or their refpedive Hand or Hiuids. XXJf. And that the Quarters both of the faid Marine Officers and Private Men, while on Shore as aforefnid, may during the Continuance of this Act be duly paid and fatisficd, and his Majefty'j Duties of Excifc better anfwered, Be it enaited by the Authority aforefaid, That from and after the fiid twenty-fifth Day oi March one thoufand feven hundred and fixty, every Officer or other Perfon to whom it belongs to receive, or that fhall aftually receive, the Pay or Subfiflence-money for one or more particular Company or Companies of the faid Marine Forces, or otherwife, fhall immediately, upon each Receipt of every particular Sum which {hall from time to time be paid returned, or come to his or their Hands, on account of Pay or Subfiftence, give publick Notice thereof to all Perfons keeping Inns, or other Places where Officers or private Men are quartered by virtue of this A61 ; and fliall alfo appoint the faid Likeepcrs and others to repair to their Quarters at fuch Times as they fhall appoint for the Diftriburion and Payment of the faid Pay or Subliltence- moncy to fuch Officers or Private Men, which fhall be within four Days at the farthefl: after the Receipt of the fame as aforefaid ; and the laid Inkeepers and others fliail then and there acquaint fuch Officer or Officers with the Accounts or Debts (if any fhall be) between them and the Officers and private Men fo quartered in their refpedlive Houfes ; which Accounts the faid Officer or Offi- cers is or are hereby required to accept of, and immediately pay the fame, before any Part of the faid Pay or Subfiftence be diftributed either to the Officers or Private Men : Provided the faid Ac- counts exceed not, for one Marine Commiffion Officer under the Degree of a Captain, for fuch Of- ficer's Diet and fmall Beer, per- Diem^ one Shilling ; and if fuch Officer fhall have a Horfe or Horfes, for each fuch Horfe or Horfcs, for their Hay and Straw, per D'lcm^ fix Pence ; nor for one Private Man's Diet and Small Beer, per Diem., four Pence : And if any Officer or Officers as aforefaid fhall not give Notice as aforefaid, and fliall not immediately upon producing fuch Account flated, fa- tisfy, content, and pay the fame ; upon Complaint and Oath made thereof, by any two Witncfles, at the next Quarter Seffions for the County or City wherein fuch Quarters were (which Oath the Juftices of the Peace at fuch Seffions are hereby authorized and required to adminifter) the Pay- mafter or Perfon for the Time being authorized to pay the faid Marine Forces is hereby required and authorized (upon Certificate of the faid Jurtices before whom fuch Oath was made, of the Sum due upon fuch Accounts, and the Perfons to whom the fame is owing) to pay and fatisfy the faid Sums out of the Arrears due to the faid Marine Officer or Officers ; upon Penalty that fuch Paymafler or Perfon fliall forfeit their refpe6tive Place or Places of Paymafter or otherwife, and be difchargcd from holding the fame for the future: And in cafe there fhall be no Arrears due to the faid Officer or Officers, then the faid Paymaller or Perfon for the Time being authorized to pay the faid Marine Forces, is hereby authorized and required to dedu£l the Sums he fhall pay, purfuant to the Certi- ficate of the faid Juftices, out of the next Pay or Subfiftence-money of the Company to which fuch ard Officer to be cafliier- Officer or Officers fhall belong; and fuch Officer or Officers fhall for fuch their OfJence, or for ne- gle<51i:ig to give Notice of the Receipt of fuch Pay or Subfiftence-money as aforefaid, be deemed and taken, and are hereby declared ipfo fa^o cafhiered. XXIII. And where it fhall happen that the Subfiftence-money due to any Marine Officer or Private A4an fhall, by Occafion of any Accident, not be paid to fuch Officer or Private Man, or fuch Officer or Private Man fhall negle£l to pay the fame, fo that Quarters^ cannot be, or are not paid, as this Ail dircds ; In every fuch Cafe it is hereby further enacted. That every fuch Officer ters, the Officer to make fjiall before his or their Departure out of his or their Quarters, where fuch Company fhall remain up Accounts, and give i^^^ ^^^ Time whatfocver, make up the Accounts as this A61 diredls, with every Perfon with whom fuch Company fhall have Quartered, and fign a Certificate thereof, and give the faid Certificate fo by him figned, to the Party to whom fuch Money is due, with the Name of fuch Company to which he or they fhall belong to the end the faid Certificate may be forthwith tranfmitted to the proper Paymafter of the Marines, who is hereby required immediately to make Payment thereof to the Perfon or Perlbns to whom fuch Money fhall be due, to the end the fame may be applied to fuch Company j under Pain as is before in this A<St directed for Nonpayment of Qiiarters. XXIV. And be it enacSlcd by the Authority aforefaid, That it fhall and may be lawful to quarter Officers and private Men of his Majefty's Marine Forces, in Scotland, in fuch and the like Places and Houfes as Officers and private Men of the Land Forces might have been quartered in by the Laws in Force in Scotland at the Time of the Union ; and that the Pofleflbrs of fuch Houfes fhall only be liable to furnifh the faid Marine Officers and Private Men quartered there, as by the faid Laws in Force at the Time of the Union was provided with refpeft to the Officers and Private Men of the Land P'orces ; and that jio fuch Marine Officer fhall be obliged to pay for his Lodging, where he fliall be regularly billeted, except in the Suburbs oi Edinburgh.
