C; §. 425 ing duly required thereunto by the faid Lord High Admiral, or three or more of the Commiflioners for executing the Office of Lord High Admiral for the Time being, by an Order in Writing under his or their refpedive Hand or Hands, fliall, as often as fuch Order ihall be brought and fliewn unto one or more fuch Juftices by the Officer or Officers of the Company or Companies of Marines fo ordered to march, ifTue out his or their Warrant or Warrants to the High Conitables or Petty Con- ftables of the Divifion, Riding, City, Liberty, Hundred, or Precin£l, from, through, near, or to ■which fuch Company or Companies {hall be ordered to march ; requiring them to make fuch Pro- vifion for Carriages, with able Men to drive the fame, as Ihall be mentioned in the faid Warrant-, allowing them fufficient Time to do the fame, that the neighbouring Parts may not always bear the Burthen : And in cafe fufficient Carriages cannot be provided within any fuch Riding, City, Liberty, Hundred, Divifion, or Precinct ; then the next Jultice or Juftices of the Peace of the County, Riding, or Divifion (hall, upon fuch Order as aforefaid being brought or {hewn to one or more of them, by any of the Marine Officers aforefaid, iflue his or their Warrant or Warrants to the High Conftables or Petty Conftables of fuch next County, Riding, Liberty, Divifion, or Precinct, for the Purpofes aforelaid, to make up fuch Deficiency ; and the aforefaid Officer or Of- ficers, who by virtue of the aforefaid Warrant or Warrants from fuch Juftice or Juftices of the Peace, is or are to demand the Carriage or Carriages therein mentioned, of the High Conftable or Petty Conftable to whom the Warrant is diredl:ed, is and are hereby required at the fame Time to pay down in Hand to the faid Conftable or Petty Conftable, for the Ufe of the Perfon who {li all Rates for Carriages, provide fuch Carriages and Men, the Sum of one Shilling for every Mile any Waggon with five Horfes fliall travel ; and the Sum of one Shilling for every Mile any Wain with fix Oxen, or four Oxen with two Horfes, {liall travel; and the Sum of nine Pence for every Mile any Cart with four Horfes {liall travel ; and fo in Proportion for lefs Carriages ; for which refpeclive Sums fo received, the faid Conftable or Petty Conftable is hereby required to give a Receipt in Writing to the Perfon or Perfons paying the fame : And fuch Con{lable or Petty Conftable {hall order and appoint fuch Per- fon or Perfons, having Carriages within their refpedive Liberties, as they {hall think proper, to provide and furnifh fuch Carriages and Men, according to the Warrant aforefaid, who are hereby required to provide and furnifh the fame accordingly : And if any Marine Officer or Officers, for pg^^jty o„ officers for- the Ufe of whofe Company or Companies the Carriage was provided, fliall force and conftrain any cing Waggons to travel Wafcron, Wain, Cart, or Carriage, to travel more than one Day's Journey, or fliall not difcharge more than one Day's the fame in due Time for their Return Home, or fliall fuffer any Marine or Servant (except fuch Journey, &c, as are fick) or any Woman, to ride in the Waggon, Wain, Cart, or Carriage aforefaid, or {hall force any Conftable, or Petty Conftable, by Threatenings or menacing Words, to provide Saddle Horfes for themfelves or Servants, or fhall force Horfes from the Owners by themfelves. Servants, or Private Men ; every fuch Officer, for every fuch Offence, {hall forfeit the Sum of five Pounds ; Proof thereof being made upon Oath before two of his Majefly's Juftices of the Peace of the fame County or Riding, who are to certify the fame to the proper Paymafter of his Majefty's Marine Forces, who is hereby required to pay the aforefaid Sum of five Pounds accordingly to the Order and Appointment under the Hands and Seals of fuch Juftices of the Peace, and is alfo hereby im- powered to deduct the fame out of fuch Officer's Pay. XXVL And be it enacted by the Authority aforefaid. That if any High Conftable or Petty Con- Penalty on Conflables, ftable fliall wilfully neglect or refufc to execute any fuch Warrant of the faid Juftice or Juftices of &c. Negleft. the Peace, as fliall be directed unto fuch Conftable or Petty Conftable for providing Carriages as aforefaid ; or if any Perfon or Perfons,' appointed by fuch Conftable or Petty Conftable to provide or furnifti any Carriage and Man, fliall refufe or neglect to provide the hme ; or any other Perfon or Perfons whatfoever fhall wilfully do any A6t or Thing, whereby the Execution of any fuch War- rant or Warrants fliall be hindered or fruftrated ; every fuch Conftable or other Perlbn or Perfons fo offending {hall, for every fuch Offence, forfeit any Sum not exceeding forty Shillings, nor lefs than twenty Shillings, to the Ufe of the Poor of the Parifli v/here any fuch Offence fhall be com- mitted : And all and every fuch Offence and Offences fliall and may be enquired of, heard, and fully determined by two of his Majefty's Juftices of the Peace, dwelling in or near the Place where fuch Offence fliall be committed, who have hereby Power to caufe the faid Penalty to be levied by Diftrefs and Sale of the Off'ender's Goods and Chatties, rendering the Overplus (if any) to the Owner. ' XXVIL And whereas the refpe6tive Sums of Money by this A6t appointed to be paid to the ' Conftables by the Officers demanding fuch Carriages, may not in many Cafes be fufficient to an- ' fwer the Charge and Expence of providing the fame, whereby the laid Confliables may be frc- ' quently at great Charges, over and above what is received by them of the faid Officers, to the great ' Burthen of the Townfhip of which they are refpeitively Conftables, or elfe the Perfons furnilliing
