And be it further cnafted by the Authority aforefaid, That if any A£lion or Suit fhall be commenced againfl: any Perfon or Perfons, for any Thing done in purfuance of this Aft, every fuch Adtion and Suit fhall be commenced within the Space of fix Calendar Months next after the Caufe of fuch Action or Suit fhall have arifen, and not afterwards ; and the Defendant or Defendants in all fuch Aftions and Suits may plead the General IfTue, and give the Special Matter in Evidence, at any Trial to be had thereupon ; and that the fame was done in purfuance of this Act : And if the fame fhall appear to have been fodone, or if any fuch Action or Suit fhall not be commenced within the Time before limited ; then and in either of fuch Cafes, the Jury fhall find for the Defendant or Defendants ; and if a Verdict fliall be found for the Defendant or Defendants, or if the Plaintiff or Plaintiffs fhall be nonfuited, or fuffer a Difcontinuance, after the Defendant or Defendants fhall have appeared, or if upon anv Demurrer, Judgment fnall be given for the Defendant or Defen- dants ; in each of the Cafes aforefaid, the Defendant or Defendants fhall have Treble Cofts, and fliall have fuch Remedy for recovering the fame, as any Defendant or Defendants hath or hayo for recovering Cofls in other Cafes by Law. An A6t for adding certain Annuities granted in the Year one thoufand feven hundred and jfifty-nine, to the Joint Stock of Three per Centum Annuities, confolidated by the Ads of the twenty-fifth, twenty -eighth, twenty-ninth, and thirty- fecond Years of his pre- lent Majefly's Reign, and for carrying the feveral Duties therein mentioned to the Sink- ing Fund ; and for cancelling fuch Lottery Tickets as were made forth in purfuance of an A61 of the thirtieth Year of his prefent Majefty's Reign, and were not difpofed of. WHEREAS in purfuance of an A£t of Parliament made in the thirty-fecond Year of his prefent Majefly's Reign, intituled, Jn J^'l for ^ratiting to his Majefty a Sulftdy of Poundage upon certain Goods and Aierchajidixes to be imported into this Kingdjm ; and an additional Inland Duty on Coffee and Chocolate ; and for raifing the Su?n of fix millions fix hundred thovfand Pounds, by ivciy of Annuities and a Lottery^ to be charged on the faid Sulfidy and additional Inland Duty ; feveral Perfons, Bodies Politick or Corporate, have advanced and lent the Sum of fix millions fix hundred thou- fand Pounds, upon the Credit of the Subfidy of Poundnge upon certain Goods and Merchandizes to be imported into this Kingdom, and the additional Inland Duty on Coffee and Chocolate, by the faid A6t granted, for the Puachafe of Annuities, after the Rate of three Pounds per Centum per Annum, transferrable at the Bank of England, and redeemable by Parliament: And whereas an additional Capital of fifteen Pounds, was by the faid A£t dire£ted to be added to every one hun- dred Pounds advanced towards the faid Sum of fix millions fix hundred thoufand Pounds, amount- ing to nine hundred and ninety thoufand Pounds, to be attended with like Annuities, after the Rate of three Pounds per Centum per Annum : And whereas it is thought neccffary that the faid principal Sum of fix millions fix hundred thoufand Pounds, together with the faid additional Ca- pital of fifteen Pounds added to every one hundred Pounds advanced towards the faid Sum of fix millions fix hundred thoufand Pounds, amounting to nine hundred and ninety thoufand Pounds, fhould be (with the Confcnt of the Proprietors thereof, to be fignified within the Time herein after mentioned) added to, and made a Part of the Joint Stock of Three Pounds per Centum tranf- ferrable Annuities at the Bank of England; and that the Charges and Expences in rcfpeit thereof, fhould he charged upon and paid out of the Fund commonly called The Sinking Fund, until Re- demption thereof by Parliament, in the fame and like Manner as the Annuities aforefaid are paid and payable ; and that the Subfidy of Poundage upon certain Goods and Merchandizes to be im- ported into this Kingdom, and the additional Inland Duty on Coffee and Chocolate, which by the faid Act were made a Fund for Payment of the faid three Pounds ter Centum Annuities, fhould be carried to and made a Part of the faid Fund, commonly called The Sinking Fund:' May it therefore pleafe your mofl Excellent Majefly, that it may be ena6ted; And be it enacted by the King's moft Excellent Majelty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affcmbled, and by the Authority of ti.e fame, That from and after the fifth Day of January one thoufand feven hundred and fixty, the principal Sum of fix n.i!Ii-'.ns fix hundred thoufand Pounds, borrowed by virtue of the laid before recited Adt, together v.ith the faid additional Capital of fifteen Pounds added to every one hundred Pounds advanced towards the faid Sum of fix millions fix hundred thoufand Pounds, amounting to nine hun- dred and. ninety thoufand Pounds, carrying an Inteieft after the Rate of three Pounds per Centum p-r Annum, payable at the Bank of England, fhall with the Confent of the Proprietors as afonfaid, be added to and made a Part of the Joint Stock of three Pounds per Centum transfjirable Annuities at the Bank of England^ confolidated by the Ads made in the twenty-fifth, twenty-eighth, twenty- ninth
