C. ii. 31 paid, or laid out for fuch Carriages, over and above what was or ought to have been paid by the Marine Officer requiring fuch Carriages, out of the publiclc Stock of fuch County or Riding, according to fuch Rates, Orders, Rules and Directions as the faid Juftices of the Peace, in their Q^iartcr-Seffions aflem- bled, within their refpedlive Jurifdiftions, fhall from time to time, during the Continuance of this A(5t, make, direct and appoint (which Orders fhall be made without Fee or Reward) Regard being always had to the Seafon of the Year, and the Length and Condition of the Roads through which fuch Car- riages are to travel.
- XXVII. And in cafe the faid publick Stock of the County or Riding be not fufficicnt (over and
- above the other Purpofes for which it was raifed) to fatisfy the extraordinary Charge of Carriages be-
' fore mentioned;' It is hereby farther ena£ted, That the faid Juftices of the Peace in the General Q^iar- The Money for ter-Seffions fhall have Power, from time to time, to raife Monies upon the refpe£tive Counties or Ri- ^^^^^'^^^^^"atr d dings, in fuch Manner as they now raife Monies for building or repairing County Gaols and Bridges, to ° fatisfy the faid extraordinary Charge of Carriages. XXVIII. Provided always, and be it further enacted. That no Waggon, Wain, Cart or Carriage, ^<'W^^2?°"'*c* imprefled by the Authority of this A6t, fhall be liable or obliged, by Virtue of this A<5t, to carry above 2o""ndred^^ twenty hundred Weight; any Thing in this A6t contained to the contrary notwithftanding. Weight. XXIX. And be it further ena£ted. That the Carriages for the Service of the A4urine Forces, quar- Carriages in tered or marching in Scotland^ fhall be provided in like Manner, and at the Rates, and the Furnifher of Scotland huw to fuch Carriages fhall be paid, as was dire6ted by the Law in Force in Scotland at the Time of the Union ^* pfvided. with regard to the furniming Carriages for Land Forces. XXX. And be it enacted by the Authority aforefaid. That if any Officer, Military or Civil, by this Marines Wives, A6t authorifed to quarter Marines in any Houfes hereby appointed for that Purpofe, Ihall at any Time, ^'^'^^Vwi^h- duriiig the Continuance of this A6t, quarter any of the Wives, Children, Men or Maid Servants of ourconfcnt. any Officer or Marine in any fuch Houfes, againfl the Confent of the Owners ; the Party offending, if an Officer of the Marines, fhall upon Complaint and Proof thereof made to the Commiffioners for exe- cuting the Office of Lord High Admiral, or Judge Advocate, be ipfo fa£io cafhiered ; and if a Conflable, Tythingman, or other Civil Officer, he fhall forfeit to the Party aggrieved twenty Shillings, upon Com- plaint and Proof thereof made to the next Juftice of the Peace, to be levied by Warrant of fuch Juftice, by Diflrefs and Sale of his Goods, rendering the Overplus to the Party, after deducting reafonable Charges in taking the fame.
- XXXI. And for the better Prefervation of the Game, in or near fuch Place where any Officers or Penalty on Of-
« Soldiers fhall at any Time be quartered,' Be it enafled by the Authority aforefaid. That if^/rom and J^Tn thi""* after the faid twenty-fifth Day of March one thoufand feven hundred and fifty-feven, any Officer or Ma- q^^J^^ rine fhall, without Leave of the Lord of the Manor, under his Hand and Seal firfl had and obtained, take, kill or deflroy, any Hare, Coney, Pheafant, Partridge, Pigeon, or any other Sort of Fowls, Poul- try or Fifh, or his Majefty's Game, within the Kingdom of Great Britain; and upon Complaint thereof Ihall be, upon Oath of one or more credible Witnefs or WitnefTes, convifted before any Juftice or Juf- tices of the Peace, who is and are hereby impowered and authorifed to hear and determine the fame ; (that is to fay) every Officer fo offending fhall, for every fuch Offence, forfeit the Sum of five Pounds, to be diflributed among the Poor of the Place where the Offence fhall be committed ; and every Officer commanding in Chief upon the Place, for every fuch Offence committed by any Marine under his Com- mand, fhall forfeit the Sum of twenty Shillings, to be paid and diflributed in Manner aforefaid : And if upon Convi6lion made by the Juftices of the Peace, and Demand thereof alfo made by the Conftable or Overfeers of the Poor, fuch Officer fhall refufe or neglect, and not within two Days pay the faid refpec- tive Penalties; fuch Officer fo refuftng or neglecting fhall forfeit, and is hereby declared to have forfeited his Commiffion, and his Commiffion is hereby declared to be null and void. ^ ' XXXII. And whereas feveral Marines, who being duly entered, may afterwards defert, and be found Conflables may

enafted, That it fhall and may be lawful to and for the Conftable, Headborough or Tythingman of the ^g^ry them be- Town or Place, where any Perfon, who maybe reafonably fufpedted to be fuch a Deferter, fhall be fore a Juftice, found, to apprehend, or caufe him to be apprehended, and to caufe fuch Perfon to be brought before any Juftice of the Peace, living in or near fuch Town or Place, who is hereby impowered and required to examine fuch fufpe<Sted Perfon ; and if by his Confeffion, or the Teftimony of one or more Witnefs or Witneffes upon Oath, or by the Knowledge of fuch Juftice of the Peace, it fhall appear or be found, that fuch fufpedted Perfon is a Marine duly entered, and ought to be v/ith the Company to which he be- longs ; fuch Juftice of the Peace fhall forthwith caufe him to be conveyed to the Gaol of the County or J'^'^'J;^ to ccm- Slace where he fhall be found ; or to the Houfe of Correction, or other publick Prifon in fuch Town"^"^ ' ^'"' or Place where fuch Deferter fhall be apprehended ; or to the Savoy, in cafe fuch Deferter fhall be appre- , bended within the Cities of London or IVe/immfier, or Places adjacent, and tranfmit an Account thereof ^"^'^Jj*"^^^" to the Secretary of the Admiralty for the Time being, to the End fuch Perfon may be proceeded againft secretary of the according to Law ; and the Keeper of fuch Gaol, Houfe of Correction or Prifon, fhall receive the full Admiralty.
