Anno fecundo Georgii IIL ^-S^* 6^7 fing of this Ait, the Mayor of the Borough of Bojion for the Time being, and. four other Perfons who fhall be elected by the Mayor, Aldermen and Common Council of the faid Borough, within two Months after the pafling of this A<St, arid ten other Perfons, who fhall be eleifled by the faid (leneral Commiffioners for Drainage, or any feven or more of them, at their firft General Meet- ing, fhall be and are hereby appointed Commiffioners for reftoring and maintaining the Navigation upon the River /^/V^flw, from the ///V^ SnV^^ in the City of Z,/«fi?/«, through the Borough of i^£/?5« to the Sea, under the Rules and Diredtions herein after mentioned, provided, appointed and pre- fcribed ; which Commiffioners fo to be eledled, fhall continue until the fecond Tuejday in AprU one ihoufand feven hundred and fixty-three, and fhall then and thenceforth, once in every three Years, be eleded in Manner aforefaid ; and that on the Vacancy of any fuch Commiffioner by Dcalh or Refufai to act, another Commiffioner fhall be eledted in like Manner, in the Room of the Commif- fioner fo dying or refufmg to a6l, within three Months after fuch Death or Refufai. LXXVIil. "Provided always, That at the Time the faid Mayor, Sheriffs, Citizens and Com- ETeaicn of Drainage monalty of the City of Lincoln fhall ele6l the faid four Perfons to be Commiffioners for the Navi- C°"^'"^'°"Es, to be <ration, they fhall declare, under their Common Seal, which two of them fhall aifo be Commif- c^^ omi"oil" fioners for the General Drainage ; and that the faid Mayor, Aldermen, and Common Council of the ^°^ Borough oi BoJIon^ fhall alfo at the Time of their eleiling the faid four Perfons to be Commiffioners for the Navigation, declare, under their Common Seal, which two of them fhall alfo be Commif- fiouers for the General Drainage. LXXIX. miffioners fliall be fufficient for the Purpofe of Adjournment. LXXX. And be it further enacted. That in order for the carrying on and effecting the faid in- Commiilloners of Navi- tended Navigation, the faid Commiffioners, or any five or more of them, fhall and may and they |i"°" ^° contract with are hereby authorifed and impowercd to imploy or contrail with any Perfon or Perfons, who fhali °^ "'^^ ' be willing to undertake or ingage to make the fiid River Witham navigable and paffible for Boats and other Vefills within the Limits aforefaid, or to do and execute any particular Work or Works to be appointed by the laid Commiffioners, or any five or more of them, for that Purpofe, upon fuch Terms and Conditions as the faid Commiffioners, or any five or more of them fhall think pro- per and reafonable ; and alfo that it fhall and may be lawful to and for fuch Perfon and Perfons fo to order Works upon the contra6ting, undertaking, and imployed, and his or their Agents, Workmen, Servants and La- River> or Side Rivers, &c, bourers, with the Approbation of the faid Commiffioners, or any five or more of them, and they are hereby impowered from time to time to open, cleanfe, fcour, depthen or inlarge the faid River IVitham up to Lincoln High Bridge aforefaid, new Cuts, or new River or Rivers herein before de- to make new Cut?^ Src, fcribed and intended to be made for the Purpofes of Drainage, and to make fuch new Cuts, Trenches or Paflages for V/ater, in, upon or through- the Lands or Grounds adjoining or near to the faid River, and within the Limits aforefaid as they fhall think proper, for the Navigation of Boats and other VelTels, and for the more convenient, eafy and better effe£ling the faid Purpofes of this A<St; and alfo to cut and niake ufe of the Soil of any Perfon or Perfons, Bodies Politick or Cor- "^^ porate whatfoever, within the Boundaries mentioned in this A6f, as Occailon fhall require;, and alfo ^° * to dig up, cut, remove and take away all Trees, Roots of Trees, Beds of Gravel or Sand., and any '° '^^™° other Impediments whatfoever which may hinder or obflru6l the faid intended Navigation ; and "^ ef^'^^^^'^Sfi's to cut and make wfe of alfo to build, ere(5f, fet up, make, fupport and maintain over or in the faid River, Cuts, Trenches ^°'^' ^*^* and Paflages, or upon the Lands adjoining or near to the fame, or any of them, fuch and fo many Bridges, Sluices, Locks, Wears, Pens for Water, Staunches, Dams, Wharfs, Warehoufes, Quays, Landing-places, Weigh-beams, Cranes, and other Works, at fuch Places, and in fuch Manner, as the faid Commiffioners, or any five or more of them (hall think neceflary and conve- nient, and fiom time to time to alter and repair the fame, and to make, widen or inJarge any Ways, Pafi'ages, or other Conveniences, for the conveying of Goods, Commodities, and all other Things to and from the faid River, as far as the faid High Bridge in the City of Lincoln^ and the navigable Cuts, Trenches or PafTages thereof below Cincil Dike, and for the conveying of all, Manner of Matc- jials for eredting and making the faid Works, and for altering or repairing the fame, and to place, lay, work and manufafiiure lae faid Materials, on the Grourds near to the Place or Places where the fiiiJ Works, or any of them fhall be making, eredting, altering or repairing, or are intended to be made, erededi
