D. 1762. faid refpe^ive Commiflioners, or any five or more of them, and the fald refpe^live Commiffioners, or any five or more of them, are "hereby authorized to dil'charge fuch Treafurer or Trcafurers of all fuch Monies as he or they fhall have truly accounted for ; and the faid refpeclive CommifTioners, or any five or more of them, fnall alfo at fuch Time or Times as they fliall think proper, fummon before them, and if they think fit, examine upon Oath (which Oath, as alfo the Oath or Oaths to the faid Treafurer or Treafurers, the faid refpedtive CommifTioners, or any two or more of them, are hereby hnpowered to adminifter) all or any fuch Collcdtors, Clerks, Surveyors and Perfons em- ployed in, or intrufted with the Receipt or Expenditure of any of the Monies to be raifed by virtue of this A£l; and which Colleitors, Clerks, Surveyors and Perfons employed in or intrufted as aforefaid, fhall render to the faid refpe6live Commiffioners, or any five or more of them, from Time to Time, as often as they lliall be thereunto required by the faid refpedtive Commiflioners, or any Hve or more of them, a true and perfe(5l Account in Writing of all Monies fo by them refpeclively received and paid, with the Vouchers for fuch Payments ; and alfo all Books and Papers in their Cuftody relating to_the Execution of this Act ; and in cafe any fuch Treafurer, Colle6tor, Clerk or other Officer or Perfon, fhall be found in Arrear, or refufc to account, or to pay the Money re- maining in his Hands, according to the Diredtions of the faid refpective Commiffioners, or any five or more of them, or if any fuch Officer or Perfon fhall not deliver fuch Books or Papers in his Cu- ftody as aforefaid, in every fuch Cafe it (hall be lawful for the faid refpedlive Commiffioners, or any five or more of them, by Warrant or Warrants under their Hands and Seals, to commit every fuch Officer and Perfon to the Common Gaol of the County or Place where fuch Officer or Perfon fhall refide; there to remain without Bail or Mainprize, until he fhall have made a true Account and Payment, and delivered fuch Books and Papers as aforefaid, or compounded with or fatisfied the faid refpedtive Commiffioners, or any five or more of them; which Compofition the faid refpedtive Com- miffioners, or any five or more of them, are hereby impowered to make. R'ports to be made of XCVIII. And for the more cafy colledling the faid Tolls, Be it further enadled. That every Per- LQ*i:ng bjt Navigaiion. fon having the Charge of any Boat or VefTel paffing on the faid River, Cuts or Trenches, fhall give a true Report or an Account in Writing, figned by himfelf, unto fuch Perfon or Perfons as fhall, from Time to Time, be appointed by the faid Commiffioners for the Navigation, or any five or more of them, to receive the fame, or to the Colledlor or Colledtors of fuch Tolls, and at fuch Place or Places as fhall be appointed by the faid Commiffioners, or any five or more of them, of the Weight of the Goods, Wares, Merchandizes and Commodities, which fhall be in or belong to fuch Boat or VelVel ; and alfo of the Weight of fuch Goods, Wares, Merchandizes and Commodities, as fhall have been difchargcd or taken out of fuch Boat or Veflel, before the Arrival thereof at the Place where fuch Account or Report is to be given; and in Failure of giving fuch Account or Report, or in cafe a falfe Account or Report fhall be given, every fuch Perfon fhall for every fuch Offence for- feit and pay the Sum of five Pounds, over and above the Payment of fuch Tolls; and if any Dif- ference fhall arife between any Colledtor of the faid Tolls, and the Perfon having Charge of any Boat or Veflel, or the Owner of any Goods, Wares, Merchandizes or Commodities, or Perfons adding in his Behalf, concerning the Weight of the fame, it fhall be lawful for any fuch Collcdtor to flop and detain any fuch Boat or VefTel, and to weigh, meafure or gauge, or caufe to be weighed, mcafurcd or gauged, all fuch Goods, Wares, Merchandizes, and Commodities ; and in cafe the fame fhall appear to be of a greater Weight than fuch Perfon declared the fame to be, in every fuch Cafe fuch Perfon fhall pay the Cofts and Charges of fuch weighing, meafuring or gauging; all which laid Cofts and Charges, upon Refufal of Payment thereof, on Demand, fhall and may be recove- red as the faid Tolls are appointed to be recovered ; but if fuch Goods, Wares, Merchandizes or Commodities, fhall appear to be of no greater Weight than fuch Perfon declared the fame to be, then fuch CoUedlor fhall pay fuch Cofts and Charges, and fhall alfo pay to fuch Perfon, or to the Owner or Owners of fuch Goods, Wares, Merchandizes and Commodities, one Shilling for every Hour that fuch Boat or Veflel fhall be fo detained ; and in Default of immediate Payment thereof, the fame fhall be levied by Diftrefs and Sale of the Goods and Chattels of fuch Colledtor, by War- rant or Warrants under the Hand and Seal of any Juftice of the Peace for the Parts or Place where fuch Boat or Veflel was detained, rendering the Overplus (if any be) to the Owner or Owners of^ fuch Goods and Chattels; and the faid Commiffioners, or any five or more of them, may, if they think fit, out of the Money to be raifed by virtue of this Adt, reimburfe the faid Colledtors the Mo- nies fo paid by or levied upon them, for the Detention of any fuch Boat or Vtflel. cvrnmiirion?™ may fct XCIX.
