But Pavements taken up for placing or amending Pipes, are to be repaired by the CommifliGmrs Paviours, at the Expence of the Proprietors ; and the Commiflioners may compound with the faid Proprietors for iuch Repairs, Pavements liable to be repaired by any Parifh, Body Politick or Cor- porate, are to be repaired at their Expence, by the Commiflioners Paviours ; and the C.-'mmifii-iners may compound with fuch Parifhes, &c. for «he fame. CAP. XXIII. An Aft to explain, amend, and render more effectual, an Act made in the laft Sef- fion of Parliament, intituled, An Acl for paving, cleanfmg, and lighting the Squares, Streets, and Lanes, within the City and Liberty of Weftminfter, the Parifhes of Saint Giles in the Fields, Saint George the Martyr, Saint George Bloomfbury, that Part of the Parifh of Saint Andrew's Holbourn which lies in the County of Middlefex, the fe- vetal Liberties of the Rolls and Savoy, and that Part of the Dutchy o/Lancafter which lies in the County of Middlefex, and for preventing Annoyances therein; and for other Purpofes therein mentioned. HEREAS an Ad was made in the laft Seffion of Parliament, intituled, An dtt for paving, cleanfmg and lighting the Squares, Streets and Lanes within the City and Liberty of Weftminfter, the Parijhes 0/Saint Giles in the Fields, Saint George the Martyr, Saint George Bfoomfbury, that Part of ike Parijh a/Saint Andrew's Holborn %vhich lies in the County »/"Middlefex, the feveral Liberties of the Rolls and Savoy, and that Part of the Dutchy of 'Lancafter which lies in the County of Middlefex, and for preventing Annoyances therein ; and for other Purpofes therein mentioned : And whereas the Com- miflioners for putting the laid Ad in Execution, have made fome Progrefs in the Trufts repofed in them, but find that the faid Ad is defective, with refped to fome of the Powers thereby given ; nor can the fame be effectually put in Execution, fo as to anfwer the good Purpofes thereby in- tended, unlefs fome new Powers are granted, and the faid Ad, in other Refpeds, amended and made more effectual ;' May it therefore pleafe your Majefty, that it may be enaded ; And be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Ad, any five or more of the Commiflioners appointed to put the faid former Aft in Execution, (hall be, and they are hereby declared to be, vefted with full Power and Authority to do, execute, perform and direct all and every the Purpofes, Ads, Matters and Things by the faid former Ad vefted in, or directed to be done or performed by, any greater Number or Quorum of the faid Commiflioners, except only for the Purpofe of choofing new Commiflioners in the Stead of fuch as fhall die or refufe to ad. II. And be it further enacted by the Authority aforefaid, That it fhall and may be lawful for the faid Commiflioners, or any five or more of them, at any Time when they fhall think fit, to raife, fink, or otherwife alter, the Pofition of any of the Lealen or other Pipes which, for the Purpofe of conveying Water into any Houfe, Area or other Place, fhall be laid into or from any Pipe laid d wn or placed by any of the Companies who furnifh the Inhabitants of the City or Liberty of W.flminfter with Water ; the Expence whereof {hall, from time to time, be paid out of the Mo- ney arifing by virtue, or appropriated to the Purpofes, of the faid Ad ; and fhall always be done with as little Detriment and Inconvenience to the faid refpedive Companies or Inhabitants, as the Circumftance of the Cafe will admit. III. Provided always, That fo often as any Part of the Pavements of the faid Squares, Streets or Lanes, which fhall be begun to be paved by virtue of the faid former Ad, fhall be taken up by any Perfon or Perfons, for the Purpofe of placing, altering or amending any fuch Pipe, the fame fhall, with all convenient Speed, be repaired by the Paviour or Paviours contrading with, or employed by, the faid Commiflioners, at the Expence of the Proprietor or Proprietors of the faid Leaden or other Pipes refpedively. IV. Provided likewife, That it fhall and maybe lawful for the faid Commiflioners, or any five or more of them, from time to time, to compound and agree with any of the faid Proprietor or Proprietors, for a certain Sum of Money, by the Foot or other Meafure, as the faid Commif- fioners, or any five or more of them, fhall think reafonable, in lieu and inftead of laying down or repairing fuch Parts of the faid Squares, Streets or Lanes, as fhall be neceffary to be taken up for the Purpofes aforefaid. V. And be it further enaded by the Authority aforefaid, That where any Part or Parts of the Pavements of the faid Squares, Streets and I anes, have been accuftomed or ought to be paved and repaired by any particular Parifh or Parifhes, Bodies Politick or Corporate, and not by the Owners or Occupiers of the Houfes or other Buildings adjoining to the Pavements of the faid Squares, Streets or Lanes, the fame fhall be paved and repaired at the Expence of the refpedive Parifh or Parifhes, Bodies Politick or Corporate, by the Paviour or Paviours contrading with or employed by the faid Commiflioners. VI. Provided always, That it fhall and may be lawful for the faid Commiflioners, or any five or more of them, from time to time, to compound and agree for the fame, with any fuch Parifh or Parifhes, or Bodies Politick or Corporate, for a certain Sum of Money by the Foot, or other Meafure, as the faid Commiflioners, or any five or more of them, fhall think reafonable.
