Provided' always, and be it further enacted by the Authority aforefaid, That the Prifon of the Marflialfea Pri- King's Bench, Prifpn-houfe, Lands, Gardens, and Common Side, and all the Rents, Offices, Profits, and fori &c. to bear- Perquifites of the Marfhal, and all other Officers, of the King's Bench Prifon ; and alfo the Prifon-houfe, George's Farilh, Lands > and Gardens of the Prifon of the Marfhal, and of the Marjhalfea Prifon, and all Offices* Perqui- &n:. ' fites, and Profits of the Marjlmlfea Court and Prifon, lying and being in the Parifh of Saint George the Martyr in the Borough of Southward, in the County of Surrey, and the Judges of the faid Court, and all ■Counfellors and Attornies pradtifing, or having a Right to pradtife in the faid Marjhalfea Court, and all Profits and Fees accruing to them, or any of them refpedtively, fhall be charged and afteffed to the Affeff- ment in the Parifh of Saint George aforefaid, and not elfewhere, at and after the Rate of four Shillings in the Pound ; any thing to the contrary in any wife notwithftanding. •Officers of the LXIV. And be it further enacted by the Authority aforefaid, That where any Officer or Officers be- M.n-fhalfea Court longing to the faid Prifons, fhall neglect or refute to pay the Sum or Sums of Money, which fhall be rated reefing to pay, an( j a fleff e( j upon them, or any of them, by virtue of this Act, any two or more of the Com- miffioners appointed by this Act, for the faid County of Surrey, mail and may certify, by Writing, under their Hands and Seals, fuch Neglect or Refufal, and the Sum payable by virtue of this Act, to the Com- Colleftors by miffioners for executing this Act, in the County or Place where fuch Officer or Officers refide ; and any Warrant from two or more of fuch Commiffioners are hereby authorized and required, upon Rec.ipt of fuch Certificate, Commiffioners D y Warrant under their Hands and Seals, to authorize and impower the respective Collectors of the Parifh may diftrain. or p]ace whefe fuch Officer or Officers refide, to diftrain the Goods and Chatties of fuch Officer or Offi- cers ; and the Diftrefs or DiftrefTes fo made, to detain or keep for the Space of four Days ; and if fuch Officer or Officers do not pay the faid Sum or Sums of Money, for which fuch Diftrefs fhall be made as aforefaid, within the Space of four Days, that then the faid Goods and Chatties fo diftrained as aforefaid, fhall and may be appraifed and fold by two fuch honeft and fufficient Perfons, as the faid Commiffioners, who fhall ftgn the faid Warrant, fhall nominate and appoint; and the Monies arifing thereby fhall be paid to the Collectors of the faid Parifh of Saint George, for and towards Satisfaction of the faid Sum and Sums of Money ; and the Surplus (if any be] fhall be returned to the Owner of the faid Goods, after the Charge >If no Goods fuf- of the faid Diftrefs and Sale fhall be deducted: But in cafe no Goods or Chatties of any fuch Officer or ficlent, Officer Officers can be found, fufficient to make good the Sum or Sums of Money fo affeffed, or to be affeffed upon to^eimprironed. him or them as aforefaid, that then it fhall and may be lawful for any two or more of the faid Commiffioners, by Warrant under their Hands and Seals to the refpective Collectors, or fuch Perfon or Perfons as they fhall think fit, to caufe the Perfon or Perfons of fuch refpective Officer or Officers of the faid Prifons, neglect- ing or refufing to pay as aforefaid, to be apprehended and taken, wherever he or they can or may be found, and to be committed to the common Gaol, where he or they fhall happen to be taken, there to remain without Bail or Mainprize, until Payment fhall be made as aforefaid of the Sum or Sums of Money fo •charged or afteffed upon them as aforefaid, with the Charges of fuch Profecution as aforefaid, to be allowed by the faid Commiffioners, or any two or more of them ; any thing in this Act contained to the contrary thereof in any wife notwithftanding. LXV.
