Packages, and defcribing the Name or Names of the Plantation or Plantations, and the Name of the- Colony where the fame grew or were produced and manufactured; which Affidavit fhall be attefted, under the Hand of the faid J uftice of the Peace, to have been fworn to in his Prefence; who is here- by required to do the fame without Fee or Reward : And the Collector or other principal Officer of the Cuftoms to whom fuch Affidavit fhall be delivered, fhall thereupon grant to the^Mafter, or other Perfon having the Charge of the Ship or Veflel, a Certificate under his Hand and Seal of Office (without Fee or Reward) of his having received fuch Affidavit purfuant to the Directions of this Act; which Certificate fhall exprefs the Quality of the Goods {hipped on board fuch Ship or Veflel, with and to tranfmit a Copy the Number and Denomination of the Packages : And fuch Collector or other principal Officer of of fuch Affidavit to. the the Cuftoms fhall alfo (without Fee or Reward) within thirty Days after the Sailing of the Ship-^ Secretary's office for the or Veflel, tranfmit an exact Copy of the faid Affidavit to the Secretary's Office for the refpective Colony, on Penalty or s i. CoIony or pi ant atioii where the Goods were fhipped, on Forfeiture of five Pounds. On Arrival of the Veflel XXI. And it is further enacted, That upon the Arrival of fuch Ship or Veflel into the Port of her at thePortofDifcliarge, Difcharge, either in Great Britain or any other Port of his Majefty's Dominions, where fuch Goods the Matter is to deliver may be j aw f u n y imported, the Mafter or other Perfon taking the Charge of the Ship or Veflel fhall, proper officer' a'nd mike at the Time he makes his Report of his Cargo, deliver the faid Certificate to the Colledor or other Oath of the identity of principal Officer of the Cuftoms, and make Oath before him, that the Goods fo reported are the fame the Goods, on Penalty that are mentioned in the faid Certificate, on Forfeiture of one hundred Pounds; and if any Rum or Spirits, Sugars or Paneles, Molafles or Syrups, fhall be imported or found on board any fuch Ship or Veflel, for which no fuch Certificate fliall be produced, or which fhall not agree therewith, the fame fliall be deemed and taken to be Foreign Rum and Spirits, Sugar and Paneles, Molafles and Syrups, and fhall be liable to the fame Duties, Reftrictions, Regulations, Penalties and For- feitures, in all Refpects, as Rum, Spirits, Sugar, Paneles, Molafles and Syrups of the Growth, Produce or Manufacture, of any Foreign Colony or Plantation, would reflectively be liable to by Law. XXII. Provided always, That if any Rum or Spirits, Sugar or Paneles, Molafles or Syrups, fliall be imported into Great Britain from any Britijh Colony or Plantation in America, without being included in fuch Certificate as is herein before directed, and it fliall be made to appear to the Satif- fadtion of the Commiffioners of his Majefty's Cuftoms at London or Edinburgh reflectively, that the mitted' to Entry, paying Goods are really and truly the Produce of fuch Britijh Plantation or Colony, and that no Fraud was the ufual Duties. intended, it fliall and may in fuch Cafe be lawful for the faid refpective Commiffioners to permit the faid Goods to be entered, upon Payment of the like Duties as fuch Goods would be liable to if this Law had not been made. ' XXIII. And whereas by an Act of Parliament made in the twelfth Year of the Reign of King Gharles the Second, intituled, An Aft for encouraging and increafing of Shipping and Navigation, and - feveral fubfequent Acts of Parliament which are now rn force, it is, amongft other Things, directed, ' that for every Ship or Veflel that fhall load any Commodities, in thofe Acts particularly enume- ' rated, at any BritiJ/j Plantation, being the Growth, Product or Manufacture thereof, Bonds fliall ' be given with one Surety, to the Value of one thoufand Pounds, if the Ship be of lefs Burthen ' than one hundred Tons, and of the Sum of two thoufand Pounds, if the Ship be of greater Bur- ' then, that the fame Commodities fhall be brought by fuch Ship or VelTel to fome other Britijh ' Plantation, or to fome Port in Great Britain; notwithftanding which, there is great Reafon to ap- ■' prehend fuch Goods are frequently carried to Foreign Parts, and landed there : And whereas great ' Quantities of Foreign Molafles and Syrups are clandeftinely run on fliore in the Britijh Colonies, ' to the Prejudice of the Revenue, and the great Detriment of the Trade of this Kingdom, and its ' American Plantations :' To remedy which Practices for the future, Be it further enacted by the Au- Bood and Security to be thority aforefaid, That from and after the twenty-ninth Day of September one thoufand feven hun- given purfuant to the dred and fixty-four, Bond and Security, in the like Penalty, fhall alfo be given to the Collector or recited AEt, other principal Officer of the Cuftoms at any Port or Place in any of the Britijh American Colonies or Plantations, with one Surety befides the Mafter of every Ship or VelTel that fliall lade or take on in cafe of lading any board there any Goods not particularly enumerated in the laid Acts, being the Product or Manufac- moBenicd Goods, tbi t u , re of any of ^ faid Colpnies or Plantations, with Condition, that, in cafe any Molafles or Syrups, being 3 Of TOO 1. and Goods found on board not certified for, &c. are to pay Foreign Duties.
