Where the Juftice! ne- glect to make fuch Or- der, the Maker is to make every fuch Loaf with a Places within their refpe&ive Jurifdictions, or, at any Petty-Seflion which (hall be held by any fuch Juftices within their refpedtive Jurifdictions, (hall from time to time, for their refpective Counties, Ridings, Divifions, Liberties, Rapes, Wapentakes, Cities, Towns or Places, or any Part thereof, they caufing an Entry to order or diretSt ; and every which Order (hall, with all convenient Speed after the making thereof, be entered in fome Book to be for that Purpofe provided and kept by fuch Juftices, and whereunto any Maker of Bread for Sale refiding within any fuch County, Divifion, Liberty, Rape, Wapen- take, City, Town or Place, lhall be at Liberty to refort at feafonable Times in the Day-time, and to perufe every fuch Order without being fubject or liable to pay any Fee or Reward in refpedt thereof; and fuch Juftices as aforefaid {hall, with all convenient Speed after the making any fuch he fet up in (ome Mar- Order as aforefaid, caufe a Copy thereof to be affixed or put up in fome Market or other publick 1 Town within the Divifion or Part of the County, Riding, Liberty or Place, in which fuch Order as aforefaid is to be obferved or take Place, or in fome publick Place in every City, Town or Place where fuch Order is to be obferved or take Place ; or otherwife fuch Juftices, within their refpec- tive Jurifdictions, fhall caufe a Copy of every fuch their refpective Order, with aH convenient Speed after the making thereof, to be inferted in fome publick News Paper which fhall be ufually publifhed in the County, Riding, Divifion, Liberty, Rape, Wapentake, City, Town or Place, or fome Part thereof, in which fuch Order as aforefaid is to be obferved or take Place; and if the Juftices as aforefaid fhall at any Time, in any Place, neglect or omit to make any Order, from time to time, with what Letter or Letters fuch Bread which fhall be made for Sale, of the Meal or Flour of any other Sort of Grain than Wheat, (hall be marked, then the Maker of all fuch Bread for Sale fhall, in every Place where no fuch Order fhall be made or be in Force, caufe every Loaf diftinct Capital Letters j of fuch Bread he or fhe {hall make, or caufe to be made, for Sale, or (hall fell, or offer or expofe to or for Sale, to be refpedtively marked with any two diftindt Capital Letters as he or {he fhall think fit ; and every Perfon who, after the faid firft Day of May one thoufand feven hundred and fixty- three, fhall make for Sale, fell, offer, or expofe to or for Sale, or have in his or her Cuftody, for Sale, any Loaf of any fuch Sort of Bread which fhall be made with the Meal or Flour of any other Sort of Grain than Wheat, which fhall not be marked as herein before is directed, h as that the fame may, on View thereof, be afcertained under what Denomination every fuch Loaf was made (except fuch Loaves thereof which fhall be rafped after the befpeaking or purchafing thereof, by the particular Defire of the Perfon who fhall order the fame to be rafped for his or her own Ufe) {hall, for every Time he, fhe or they fhall fo offend in the Premifles, and be thereof convicted in Manner herein after directed, forfeit and pay a Sum not exceeding forty Shillings, nor lefs than five Shil- lings, for every Loaf of fuch Bread which fhall not be fo marked as herein before is firft directed, as the Juftice or Juftices before whom any fuch Offender fhall be convicted fhall from time to time adjudge. X. And to the end the good Defign of this Statute may be more effectually accomplifhed ; Be it further enacted by the Authority aforefaid, That from and after the faid firft Day of May one thou- fand feven hundred and fixty-three, it fhall and may be lawful for any Juftice or Juftices within the Limits of their refpedtive Jurifdictions, although the Affize of Bread {hall not be there fet according and Peace Officers (au- to the faid herein before in part recited Act ; and alfo for any Peace Officer or Officers authorized thorized by Warrant of by Warrant under the Hand and Seal, or Hands and Seals, of any fuch Juftice or Juftices (and a J uftlce ) which Warrant any fuch Juftice or Juftices is and are hereby empowered to grant within their re- may enter the Houfes of fpective Jurifdictions) to enter into any Houfe, Shop, Stall, Bakehoufe, Warehoufe, or Outhoufe, en Penalty of forfeiting not exceeding 40 s. nor lefs than 5 s. for every fuch unmarked Loaf. Juftices, Bakers, and fearch for, examine and weigh all Eiead made for, or ex- jofed to Sale, &c. and Bread found defec- tive in the Weight, or not duly marked, or wanting in due Baking, or Goodnefs, or being fraudulently mixt, &c. or other Place, of or belonging to any Baker or Seller of Bread, and to fearch, view, weigh, exa- mine, and try all or any Bread which fhall be there found ; and alfo to view, weigh and try all Bread made for Sale, which at any Time fhall be offered or expofed to or for Sale, or found in any- one's Cuftody for Sale, in any wife howfoever, within the refpective Jurifdiction of any fuch Juftice or Juftices : And if any Loaf or Loaves of Bread of any Denomination {hall on any Search, View, Weighing, Trial, or Examination thereof, by any Juftice or Juftices, or on any Complaint made to, or Information given before any Juftice or Juftices, and proved by the Oath of one or more credible Witnefs or Witnefles, be found to be deficient in the due Weight the fame ought to be, or not to be marked according to the Directions and Intent of this Act, or to be deficient in the due baking or working thereof, or to be wanting in the Goodnefs of the Stuff whereof or wherewith any fuch Loaf {hall have been made, or to have been made with any Mixture of Meal or Flour of any other Sort of Grain than of the Grain the fame fhall import to be made with, or to be made with any larger or other Proportion of any other or different Sort or Sorts of Grain, or the Meal or Flour thereof, than what ought to be put therein, or to be made with any Mixture or Ingredient which by the faid in Part recited Act ought not to be put therein; or to be made with any Thing as or for or in lieu of Flour which fhall not really be the genuine Flour, the fame fhall import to be and ought to be, or that any fuch Bread fhall be made with any Leaven not allowed by the (aid in part recited Act to be ufed in making Bread ; then and in every or any of the faid Cafes, every Juftice and Juftices, Peace Officer and Officers as aforefaid, is and are hereby respectively, within m^y be feized and given the Limits of their feveral Jurifdictions, impowered and required by the Authority of this Act, to to the Poor; feize every Loaf of fuch Bread, and to difpofe thereof to poor Perfons, as fuch Juftice or Juftices that the Default found or complained of wholly arofe from fome unavoidable Accident, or was oc- cafioned
