Provided always, and be k hereby Declared, That if it happen that feveral Talleys of Loan, or Orders for Payments; as aforefaid, bear Date, or be brought the fame day to the Auditor of the Receipt to be Regiftred, Then it fhall be interpreted no undue Preference which of thofe he Enters rirft, fo he Enters them all the fame da,y. ',.-. ; IMJ. 1 XXX. Provided-alfo, That it ihall not be interpreted any undue Preference to incur any Penalty in point of payment, if the Auditor Direct, and- the 'Cleric of the Pells- Record, and the Teller do pay fubfequent Orders of Perfons that come and demand their Money, and bring their Orders before other Perfons that did not come to demand their Money, and bring their Order in their courfe, fo as there be lb much Money referved as will fatisfie precedent Orders, which lhall not be otherwife difpoled, but kept for them, (Intereft upon Loan being to ceafe from the fime the Money is fo referved and kept in Bank for them.) XXXI. And be it further enacted by the Authority aforefaid, That every Perfon or Perfons to whom any Money fhall.be due by virtue of this Act, after Order Entred in the Book of Regifter aforefaid for payment thereof, his Executors, Adminiftrators or Affigns, by Indorfement of his Order may Affign and Transfer his Right, Title, Intereft and Benefit of fuch Order, or any part thereof, to any other; which being notified in the Office of the Auditor of Receipt aforefaid, and an Entry or Memorial there- of alfo made in the Book of Regifter aforefaid fof Orders (which the Officers fhall upon requeft, with- out Fee or Charge, accordingly make) fhall Entitle fuch Affignee, his Executors, Adminiftrators and Affigns, to the Benefit thereof, and Payment thereon; "and fuch Affignee may in like manner Affign again, and fo toties auoties ; and afterwards it fhall not be in the power of fuch Perfon or Perfons who have made fuch Alignments, to make void, releafe of difcharge the fame, or any the Moneys thereby due, or any Part thereof. XXXII. And be it further Enacted by the Authority aforefaid, That if any Action, Suit, Plaint or Information fhall be Commenced or Profecuted againft any Perfon or Perfons, for what he or they fhall do in purfuance, or in Execution of this Act, fuch Perfon or Perfons fo Sued in any Court whatfoever, fhall and may Plead the General Iffue, Not guilty, and upon any Iffue joyned, may give this Act, and the Special Matter in Evidence ; And if the Plaintiff or Profecutor fhall become Nonfuit, or for- bear further Profecution, or fuffer Difcontinuance, or if a Verdict pafs againft him, the Defendants fhall recover their treble Cofts, for which they lhall have the like Remedy, as in Cafe where Cofts by Law are given to the Defendants. XXXIII. Provided always, and be it. Enacted, That every Rate, Tax or Affeffment which fhall be made or impofed by virtue of this Act of Parliament, in refpect of any Houfe or Tenement which an Embafiador, Refident, Agent, or other Pubiick Minifter of any Foreign Prince or State now doth, or fhall hereafter inhabit or occupy, lhall be paid by the Landloid or Owner of the faid Houfe or Tene- ments refpecuvely. XXXI V . And be it further Enacted by the Authority aforefaid, That in all Priviledged and other Places,- being ExtraparochiaL, .. or nat.within any the Conftablevvicks or _ Precincts of. the refpeclive Affef- fors, to be appointed by virtue of this Act (although in any Monthly or other Tax they have not been Affeffed or Rated heretofore) the faid Commiffioners, or any two or more of them fhall, and are hereby required to nominate and appoint two fit Perfons living in or- near the faid Priviledged or other Places, as aforefaid, to be AfTeffors for the faid Places, and to make and return theff Affeffments in like manner as by this Act is appointed in any Pari fir, Ty thing j or Place, and alfo to appoint one or more Col- lectors, who are hereby required to Collect and Pay the fame according to the Rules appointed by this Act for Collecting and Paying all Sums of Money payable by this Act. XXXV. Provided always, That nothing in this Act contained lhall be conftrued to alter, change, determine, or make void any Contracts, Covenants or Agreements whatfoever between the Landlord and Tenant, touching the payment of Taxes or AffdTments; Any thing herein before mentioned to the contrary notwithitanding. ■XXXVI. Provided always, and be it further Enacted by the Authority aforefaid, That no Comrnif- fioner or Commiffioners who fhall be Employed in the Execution of this Act, lhall be liable for, or by reafon of fuch Execution to any of the Penalties mentioned in an Act made the Five and twentieth -Year of King Charles the Second, Far the preventing of Dangers which may happen from Popijh Recufants. - . . XXXVII. Provided always, and be it Enacted by the Authority aforefaid, That from and after the Four and twentieth day of June, in the Year of our Lord Qne thoufand fix hundred eighty and nine, the Officers of the Receipt of their Majefties Exchequer, fhall 2nd may receive and take for their Fees, Three farthings in the Pound, and no more, for all, or any Sum or Sums of Money to be iffued or paid to any of their Majefties Garrifons, or other Land Forces, out of the Moneys ariiing by an Act Entituled, An AEl for the Granting a prefent Aid to their Majejiies, An Act Entituled, An Ail for Raijing Money by a Poll, ana otherwife, towards the Reducing of Ireland, and by this prefent Act, or any other Act to be granted or made during this prefent Seffion of Parliament. XXXVIII. And it is hereby further Enacted by the Authority aforefaid, That an Accompt fhall he given and made unto the Commons- in Parliament Allembled, of and for all and every Sum and Sums of Money whatfoever, that fhall be Collected, Levied and Paid to the Ufe of their Majefties by Virtue of this prefent Act, or of any other Act or Acts Made or Paffed, or to be Made or Paffcd at any time or times during this prefent Seffions of Parliament.
