FORSAMEIKLE As the Kingis Majeftie , with advife of his Eftaites in Parliament, lies confirmed and eftabliihed , the jurifdiftion and judicatours of the Kirk, in the generall and Synodall aflemblies, Presbyteries, and particular Seffiones of everie Kirk and Paroche , willing and ordaining their fentencesand decreetes, in maters perteining to their judicatour , to be put in execution , and take full efTecl: : And it is of veritie , that a number of obflinat and flubborne people , in divcrfe Paroches of this Land , hath contemned, and daylie contemnis the fentences and decreetes of the faidis aflemblies and judicatures of the Kirk; Na- melie in Land- wart Paroches , quhair there is little, or na concurrence of Magiftrates , to punifh obflinat and difobedient perfones : And the faid Kirk having na uther puniihment in their handes bot Spirituall; the quhilk the faid obflinate people (being altogether flelhlie and beaftlie) feelis not , nor fettis not by. There- fore OUR SOVERAINE LORD, With advife of the faidis Eftaites , for rcmeid hereof , hes fta tute and ordained , that in-cafe ony of his fubjecles within this Realme, refufis to obey the ordinances and decreetes of the faidis Aflemblies andjudicatoures of the Kirk , in ony time to cum , the faidis Aflemblies and judicatoures , fall dired their Bedle to the perfone orperfonnes difobedient, chargeing and commanding I them in the name of God and the King , to obey their decreete and ordinance : The quhilk charge , gif the i faid perfon or perfones contemne , and remaine obflinat; 1 he Minifler of the Paroche, quhair the laid perfon or perfones remainis , fall three feverall Sabboth-dayes from Pulpit, charge and command the faid perfon or perfones , in the name of God and the King, to obey the famin ordinance and decreete : And in- cafe notwithflanding , all the faidis charges , the faid perfon or perfones remainis flill obflinate and rebelli- ous; Then fall the faide Aflemblie or judicatoures, quhilk hcs maid the faid ordinance and decreete, meane the mater be their fupplication , to the Lordes of Selfion , conteiningthe fubflanceof the Procefle, the fentence and decreete pronunced againfl the faidis perfone or perfones , with a complaint of their con- tempt and difobedience : Quhair-upon the partie compleined on , being firfl cited and heard to propone their lauchfull defenfes , in-cafe they compeir : And gif they compeirnot, propter contumaciam, The faidis Lordes of Seffion , orfecreitCouncell, fall give out letters , to put the faid perfon or perfones to the home, within ten dayes nixt after the charge, in-cafe of difobedience , and continuing in their former con- tempt and rebellion. 161.
