' King CHARLES the II. 1661. z 7 victual or one thoufand pounds (all Few Duties being deducted) (hall be, and aire capable to voteni the Election of Commiflioners ol Parliaments, and to be elected Commiflioners to Parliaments; ex- cepting alwayes from this AcT: all Noblemen and their Vallais. And it being juft, that thole who Ihall be cholen and accordingly Ihall attend His Majefties and the Kingdoms fervice in Parliaments, have allowance for their charges; His Majefly doth therefore, with advice iorelaid, Modifie and Ap- point five pounds Scots of daily allowance- to every CommifXioner from any Shire , including the firft and laft dayes of the Parliament, together with eight dayes for their commmg, and as much for their return, from the furtheft Shires oiCaithnefiawi Sutherland; and proportionably at nearer di- ftances; and that the whole Free-holders, Heritors and Liferenters, holding of the King and Prince> Jhall according to the proportion of their Lands and Rents, lying within the Shire, be lyable and oblieged in the payment ot the laid allowance, excepting Noblemen and their VaiTals. For payment of which, all execution of Horning, Poynding and Quartering is to pafle, as for raifing oi the Excite, and that according as the time and dayes oi the Parliament lliall be attefted under the Clerk oi Re- giflers hand. And becauie at this time, feme Commiflioners of Shires have been put to extraordi* nary expences in providing ot Footmantles for the riding . of the Parliament; It is hereby Statute - t That the Commiilioners ihall be relieved of the prices thereof, to be given in under their hands ; and that the prices di the Footmantles be raifed in the lame way and by the fame execution, with the daily allowance aforefaid; the Commiflioners alwayes, at the riling of each Parliament , making the Footmantles forthcoming to the Shire, to be difpofed as they lliall think fit. XXXVI. A£i anent Prefentation of Minifters. FOrafmuch as the Kings moft Excellent Majefty , considering how neceffar it is for the right and orderly adminiftration of GOD's Worlhip, and the exerciies of Religion, and for keeping of His good Subjects within their duties they owe to G O D , to His Majejly , to their Native Coun* trey, and fellow Subjects, efpecially at this time after fo many confufions and dilt rations , both a- mong Church-men and others ; That more then ordinary care be had in preienting oi Minifters to all fuch Kirks as are, or ihall be vacand within this Kingdom; hath given particular Commiflion un- der His great Seal, as to all Prefentations to all Perfonages, Vicarages, and other Benefices and Kirks at His Majefties prefentation. And as to all other Benefices and Kirks, whereof the prefentation belongs to any other Patron or Patrons whatioever, His Majesty, with advice and content of His E- ftates of Parliament, Statutes and Ordains, That all Patrons or Perlbns whatioever, who hath, or pretends any right to the Prefentations to any Patronages , Vicarages , or other Benefices of Cure, Kirks or modified Stipends ; be careful in all time coming, that Prelentations to theie Benefices, Kirks or Stipends, be granted by them to iuch perfons only, as Ihall give fufrcient evidence of their Piety, Loyalty, Literature and peaceable Dilpofition ; And Ihall, in prefence oi the Patron or his I Atturney, and of the Sheriff of the Shire, Stewart of the Stewartry, or lierctable Baily or Commit far of the bounds, if it be in the Countrey, and of the Magiitrates ot the Burroughs within the Burgh, before the granting and their accepting the Prefentation, take and lubicribe the Oath of Ak lcagiance, the faid Sheriff, Stewart, Baily, CommifTar and Magiitrates having firil taken the Oath I themfelves. And it is hereby Declared , That it any perlbn who hath not lo taken the Oath ot Al- leagiance, lliall be prefehted by any Patron, not only Ihall the Prefentation be void and null of it fell , but the right of the Patronage, as to that vacancy, Ihall belong to the Kings Majejly , and the Patrons be repute difaffecFed to His Majefties Government, and contemners of His Royal Au- thority.
