Communications and telecommunications.

To amend title 17, United States Code, to clarify the definition of the local service area of a primary transmitter in the case of a low power television station.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the fourth paragraph of section 111(f) of title 17, United States Code, relating to the definition of local service area of a primary transmitter, is amended by adding after the first sentence the following new sentence: "In the case of a low power television station, as defined by the rules and regulations of the Federal Communications Commission, the 'local service area of a primary transmitter' comprises the area within 35 miles of the transmitter site, except that in the case of such a station located in a standard metropolitan statistical area which has one of the 50 largest populations of all standard metropolitan statistical areas (based on the 1980 decennial census of population taken by the Secretary of Commerce), the number of miles shall be 20 miles.". SEC. 2. (a) Section 111(d) of title 17, United States Code, is amended— (1) in paragraph (3) by striking out "clause (2)" and inserting in lieu thereof "paragraph (1)"; (2) in paragraph (2) by striking out "clause (5)" and inserting in lieu thereof "paragraph (4)"; (3) in paragraph (2)(B) by striking out "clause (5)" and inserting in lieu thereof "paragraph (4)"; (4) by striking out paragraph (1); and (5) by redesignating paragraphs (2), (3), (4), and (5) as paragraphs (1), (2), (3), and (4), respectively. (b) Section 111(f) of title 17, United States Code, is amended by striking out "subsection (d)(2)" in the third undesignated paragraph defining a cable system and inserting in lieu thereof "subsection (d)(1)". (c) Section 801(b)(2) of title 17, United States Code, is amended by striking out "111(d)(2)(B)" each place it appears and inserting in lieu thereof "111(d)(1)(B)". (d) Section 801(d)(2)(D) of title 17, United States Code, is amended by striking out "111(d)(2)(C) and (D)" and inserting in lieu thereof "111(d)(1)(C) and (D)". Approved August 27, 1986.
