PUBLIC LAW 101-189—NOV. 29, 1989 103 STAT. 1383 (A) AH-64 aircraft acquired by the Army on or before the date of enactment of this Act; (B) AH-64 new production aircraft for which funds, other than funds for the procurement of long lead items and other advance procurement, were obligated before the date of enact- ment of this Act and which are delivered to the Army on or after that date; and (Q 132 new production AH-64 aircraft for which funds are available in accordance with subsection (b)(l)(Q* SEC 133. AHIP SCOUT AIRCRAFT PROGRAM (a) IN GENERAL.—(1) The Secretary of Defense shall terminate the AHIP Scout aircraft program in accordance with this section. (2) Except as provided in subsection (b), funds appropriated or otherwise made avail£ple to the Department of Etefense pursuant to this or any other Act may not be obligated for the procurement of AHIP Scout aircraft (OH-58 aircraft modified into the configuration specified in the Army Helicopter Improvement Program described in the Selected Acquisition Report, dated December 31, 1988, relat- ing to the OH-58 helicopter). (b) EXCEPTIONS.—(1) Subject to subsection (c), the prohibition in subsection (a)(2) does not apply to— (A) the modification of, or the acquisition of spare or repair parts for, AHIP Scout aircraft described in paragraph (2); (B) completion of the installation of AHIP modification kits in the AHCP Scout aircraft described in paragraph (2)(B); and (O the obligation of not more than $195,000,000 from funds made available pursuant to section 101(a) for the procurement and installation of AHIP modification kits in not more than 36 AHIP Scout aircraft and for payment of costs necessary to terminate the AHEP Scout aircraft program. (2) The AHLP Scout aircraft referred to in paragraph (I)(A) are— (A) AHIP Scout aircraft acquired by the.^^-my on or before the date of enactment of this Act; (B) AHIP Scout aircraft for which funds, other than funds for the procurement of long lead items and other advance procure- ment, were obligated before the date of enactment of this Act and which are delivered to the Army on or after that date; and (Q 36 AHIP Scout aircraft for which funds are available in accordance with subsection O^XIXO. fSEC 134. F -15E AIRCRAFT PROGRAM (a) IN GENERAL.—(1) The Secretary of Defense shall terminate new production of F-15E aircraft in accordance with this section. (2) Except as provided in subsection 0)), funds appropriated or otherwise made available to the Department of Defense pursuant to this or any other Act may not be obligated for the procure- ment of F-15E aircraft. (b) EXCEPTIONS. —(1) The prohibition in subsection (a) does not apply to the obligation of funds for— (A) the completion of, the modification of, or the acquisition of spare or repair parts for, F-15E aircraft described in paragraph i (2); or (B) the payment of costs necessary to terminate the F-15E aircraft program.
