PUBLIC LAW 101-239—DEC. 19, 1989 103 STAT. 2485 (1) OLD-AGE, SURVIVORS, AND DISABILITY INSURANCE.— Section 206(a) of the Social Security Act (42 U.S.C. 406(a)) is amended by adding at the end the following new sentence: "The Secretary shall maintain in the electronic information retrieval system used by the Social Security Administration a current record, with respect to any claimant before the Secretary, of the iden- tity of any person representing such claimant in accordance with this subsection.". (2) SUPPLEMENTAL SECURITY INCOME.— Section 1631(d)(2) of such Act (42 U.S.C. 1383(d)(2)) is amended by adding at the end the following new sentence: "The Secretary shall maintain in the electronic information retrieval system used by the Social Security Administration a current record, with respect to any claimant before the Secretary, of the identity of any person ' representing such claimant in accordance with this para- graph.". (3) EFFECTIVE DATE.— The amendments made by this subsec- 42 USC 406 note, tion shall take effect June 1, 1991. (b) NOTIFICATION OF OPTIONS FOR OBTAINING ATTORNEYS.— (1) OLD-AGE, SURVIVORS, AND DISABILITY INSURANCE.— Section 206 of such Act (42 U.S.C. 406) is further amended by adding at the end the following new subsection: "(c) The Secretary shall notify each claimant in writing, together ^ with the notice to such claimant of an adverse determination, of the options for obtaining attorneys to represent individuals in present- ing their cases before the l^cretary. Such notification shall also advise the claimant of the availability to qualifying claimants of legal services organizations which provide legal services free of charge.". (2) SUPPLEMENTAL SECURITY INCOME.— Section 1631(d)(2) of such Act (42 U.S.C. 1383(d)(2)) is amended— (A) by inserting "(A)" after "(2)"; and (B) by adding at the end the following new subparagraph: "(B) The Secretary shall notify each claimant in writing, together with the notice to such claimant of an adverse determination, of the options for obtaining attorneys to represent individuals in present- ing their cases before the l&cretary. Such notification shall also advise the claimant of the availability to qualifving claimants of legal services organizations which provide legal services free of charge.".
