104 STAT. 4702 PUBLIC LAW 101-645—NOV. 29, 1990 submitted (by the entity submitting the comprehensive plan) to any service providers under programs for which such entity receives assistance under this title; "(8) a strategy provided by metropolitan cities, urban counties, Indian tribes, or otherwise on a local basis, for providing a plan to encourage a program which waives certsdn local or State liability regulations or laws for those who wish to donate food to a nonprofit charitable organization or food bank for use in community shelters or other domiciles for the homeless, shall be submitted (by the entity submitting the comprehensive plan) to any service providers under programs for which such entities receive assistance under this title; and". (b) INCLUSION OF INDIAN TRIBES. —Section 401 of the Stewart B. McKinney Homeless Assistance Act (42 U.S.C. 11361) is amended— (1) in subsection (a), by adding at the end the following new sentence: "Assistance authorized by this title may be provided to any Indian tribe that is eligible to receive a grant under the emergency shelter grants progrsim in any fiscal year, but only if the tribe submits biennisdly to the Secretary of Housing and Urban Development a comprehensive homeless assistance plan under this section."; (2) in subsection (b)(5), by inserting "Indian tribe," after "State,"; (3) in subsection (c)(l), by inserting "Indian tribe," after "State," each place it appears; (4) in subsection (d), by inserting "Indian tribe," after "State," each place it appears; and (5) in subsection (g)— (A) by inserting "(or tribal agency or contact)" after "State contact person"; (B) by inserting "(or tribe)" before the comma; and (C) by inserting "(or tribal agency or contact person)" after "or contact person". (c) MODIFICATION OF DEVELOPMENT AND TIMING, CONTENT, AND REVIEW STANDARDS. — (1) PUBLIC PARTICIPATION PROCESS FOR DEVELOPMENT OF PLANS AND ANNUAL REPORTS.— Section 401 of the Stewart B. McKinney Homeless Assistance Act (42 U.S.C. 11361) is amended by adding at the end the following new subsection: " (h) CONSULTATION. — "(1) REQUIREMENT.— Each State, Indian tribe, metropolitan city, and urbsm county described in subsection (a) shall consult with, and consider the comments of, citizens, public and private homeless shelter and service providers, and local governments concerning the contents of the comprehensive plan and the annual progress report required under subsection (d), prior to their submission to the Secretary. " (2) MODIFICATION.—Each State, Indian tribe, metropolitan city, and urban county described in subsection (a) may, if it considers it appropriate, modify the comprehensive plan and annual report to refiect the comments of citizens, public and private homeless shelter and service providers, and local governments. Public "(3) AVAILABILITY. —Each State, Indian tribe, metropolitan information. gj^y^ g^jj^ urban county shall make the comprehensive plan and annual report available to the public.
