REMOVAL OF LIMITATION ON THE ACCRUAL OF SAVINGS OF MEMBERS IN A MISSING STATUS (a) ADDITION OF PERSIAN GULF CONFLICT.—Subsection (b) of section 1035 of title 10, United States Code, is amended— (1) by inserting before the period in the second sentence the following: "or during the Persian Gulf conflict"; and (2) in the last sentence, by striking out "the date designated" and all that follows through the period and inserting in lieu thereof the following: "May 7, 1975, and the Persian Gulf conflict begins on January 16, 1991, and ends on the date thereafter prescribed by Presidential proclamation or by law.". (b) MISSING STATUS DEFINED.— Such section is further amended by adding at the end the following new subsection: "(f) In this section, the term 'missing status' has the meaning given such term in section 551(2) of title 37.". (c) CONFORMING AMENDMENTS.—Such section is further amended— (1) in subsection (b), by striking out ", as defined in section 551(2) oftitle 37,"; and (2) in subsection (e), by striking out "(as defined in section 551(2) oftitle 37)". 37 USC 403 SEC. 310A. BASIC ALLOWANCE FOR QUARTERS FOR CERTAIN MEMBERS note. OF RESERVE COMPONENTS WITHOUT DEPENDENTS (a) IN GENERAL.— A member of a reserve component of the uniformed services without dependents who is called or ordered to active duty in connection with Operation Desert Storm shall be entitled to a basic allowance for quarters under section 403 of title 37, United States Code, if, because of the call or order, the member is unable to continue-to occupy a residence— (1) which is maintained as the primary residence of the member at the time of the call or order; and (2) which is owned by the member or for which the member is responsible for rental payments. (b) PERIOD OF APPLICABILITY. —Subsection (a) shall apply during the period beginning on August 2, 1990, and ending on the first day of the first month beginning on or after the date 180 days after the end of the Persian Gulf conflict. PART B—MILITARY PERSONNEL POLICIES AND PROGRAMS 10 USC 688 SEC. 311. GRADE OF RECALLED RETIRED MEMBERS (a) IN GENERAL.— A retired member of the Armed Forces ordered to active duty under section 688 of title 10, United States Code, in connection with Operation Desert Storm who had previously served on active duty satisfactorily, as determined by the Secretary of the military department concerned, in a grade higher than that member's retired grade may be ordered to active duty under that section in the highest grade in which the member had so served satisfactorily. (b) GRADE UPON RELEASE FROM ACTIVE DUTY. —(1) For the purposes of section 688(b) of title 10, United States Code, a member of the Armed Forces ordered to active duty in a grade that is higher than the member's retired grade pursuant to subsection (a) shall be deemed to have been promoted to such higher grade while on such active duty.
