TUITION REFUNDS OR CREDITS (a) SENSE OF CONGRESS.— It is the sense of the Congress that all institutions offering postsecondary education should provide a full refund to any member of the Armed Forces on active duty in connection with Operation Desert Storm for that portion of a period of instruction such individual was unable to complete, or for which such individual did not receive academic credit, because such individual was called up for such service. For purposes of this section, a full refund includes a refund of required tuition and fees, or a credit in a comparable amount against future tuition and fees. (b) ENCOURAGEMENT AND REPORT.— The Secretary of Education shall encourage institutions to provide such refunds or credits, and shall report to the appropriate committees of Congress on the actions taken in accordance with this subsection as well as information the Secretary receives regarding any institutions that are not providing such refunds or credits. SEC. 374. ELIGIBILITY OF STUDENT BORROWERS Section 731 of the Public Health Service Act (42 U.S.C. 294d) is amended— (1) in subsection (a)(2)(C)— (A) by striking "or" at the end of clause (vi); and (B) by striking "and any such period" and all that follows through "clause (B) above;" in clause (vii) and inserting the following: "and (viii) in addition to all other deferments for which the borrower is eligible under clauses (i) through (vii) during which the borrower is a member of the Armed Forces on active duty during the Persian Gulf conflict, and any period described in clauses (i) through (viii) shall not be included in determining the 25-year period described in subparagraph (B);"; and (2) by adding at the end the following new subsection: "(f) As used in this section: "(1) The term 'active duty' has the meaning given such term in section 101(18) of title 37, United States Code, except that such term does not include active duty for training. "(2) The term 'Persian Gulf conflict' means the period beginning on August 2, 1990, and ending on the date thereafter prescribed by Presidential proclamation or by law.". SEC. 375. TERMINATION OF SECTIONS 372 AND 373 The provisions of sections 372 and 373 shall cease to be effective on September 30, 1997. SEC. 376. COORDINATION WITH OTHER LAW If the Higher Education Technical Amendments of 1991 is enacted, the provisions of sections 4, 5, and 6 of that Act shall supersede sections 372, 373, and 375.
