"(4) The term 'active status' means the status of a reserve commissioned officer, other than a commissioned warrant ofiEicer, who is not in the inactive Army National Guard or inactive Air National Guard, on an inactive status list, or in the Retired Reserve. "(5) The term 'full-time National Guard duty* means training or other duty, other than inactive duty, performed by a member of the Army National Guard of the United States or the Air National Guard of the United States in the member's status as a member of the National Guard of a State or territory, the Commonwealth of Puerto Rico, or the District of Columbia under section 316, 502, 503, 504, or 505 of title 32 for which the member is entitled to pay from the United States or for which the member has waived pay from the United States. "(6) The term 'inactive-duty training* means— "(A) duty prescribed for Reserves by the Secretary concerned under section 206 of title 37 or any other provision of law; and "(B) special additional duties authorized for Reserves by an authority designated by the Secretary concerned and performed by them on a voluntary basis in connection with the prescribed training or maintenance activities of the units to which they are assigned. Such term includes those duties when performed by Reserves in their status as members of the National Guard. "(e) RULES OF CONSTRUCTION.—In this title— "(1) 'shall' is used in an imperative sense; "(2) 'may* is used in a permissive sense; "(3) 'no person may * * *' means that no person is required, authorized, or permitted to do the act prescribed; "(4) 'includes' means 'includes but is not limited to'; and "(5) 'spouse' means husband or wife, as the case may be. "(f) REFERENCE TO TITLE 1 DEFINITIONS.— For other definitions applicable to this title, see sections 1 through 5 of title 1.". (b) CROSS REFERENCE CORRECTIONS.— (1) Section 232(7) of title 18, United States Code, is amended— (A) by striking out ", but shall not be limited to, members of the National Guard, as defined in section 101(9) of title 10, United States Code," and inserting in lieu thereof "members of the National Guard (as defined in section 101 of title 10),"; and (B) by striking out ", not included within the definition of National Guard as defined by such section 101(9)," and inserting in lieu thereof "not included within the National Guard (as defined in section 101 of title 10),". (2) Section 101(26) of title 37, United States Code, is amended by striking out "section 101(47) of title 10," and inserting in lieu thereof "section 101 of title 10,". (3) Section 3401(a)(1) of title 39, United States Code, is amended by striking out "section 101(4) and (22) of title 10," and inserting in lieu thereof "section 101 of title 10,".
