(a) The rate of duty in the "Special" sUxolunn of rates of duty colum 1 followedfaythe syiit»l "CA" in parentheses shall apply to inports from Canada, up to the annual quantities specified in subdivision (f) of this note, of apparel goods provided for in chapters 61 and 62 that are both cut (or loiit to shape) and seun or otherwise assembled in the territory of a NAFTA party from fabric or yam produced or obtained outside the territory of one of the NAFTA parties. (b) The rate of duty in the "Special" sUicolijin of rates of duty colum Ifollowed by the syiiiMl "NX" in parentheses shall apply to imports from Nexico, up to the annual quantities specified in siixjivisions (9)(i) of this note, of apparel goods provided for in chapters 61 and 62 that are both cut (or knit to shape) and sewn or otherwise assenbled in the territory of a NAFTA party from fabric or yam produced or obtained outside the territory of one of the NAFTA parties. (c) The rate of duty in the "Special" subcolinn of rates of duty colum 1 followed by the synbol "HX" in parentheses shall apply to inports from Mexico, 143to the amual quantities specified in siliivision (9)(ii) of this note, of textile or apparel goods provided for in chapters 61, 62 and 63 that are seun or otherwise assait>led in the territory of Mexico, from fabric cut in the territory of the United States, such fabric having been knit or woven outside the territory of the United States or Mexico, which (i) were exported from the United States in condition ready for assenbly without further fabrication, (ii) have not lost their physical identity in such articles by change in form, shape or otherwise, and (iii) have not been advanced in value or improved in condition in Mexico except by being assembled and except by operations incidental to the assembly process. This siixlivision shall not apply after quantitative restrictions established pursuant to the Nultifiber Arrangement or any successor agreement are terminated. (d) Notwithstanding the provisions of siixjivisions (b) and (c) of this note, the rate of duty in the "Special" sUbcolum of rates of duty colum 1 followed by the syntx>l "NX" in parentheses shall not apply to inports from Nexico of the following: (i) apparel goods provided for in chapters 61 and 62, in which the fabric that determines the tariff classification of the good it classified in one of the following sii^ieadings-- (A) blue de ni m: si i:hea dir ^ 5209.42, 5211.42, 5212.24.60 and 551 4.32.00; an d (B) fabric woven as plain weave where two or more warp ends are woven as one (oxford cloth) or average yam nuiber less than 135 metric nuiter: subheadings 5208.19, 5208.29, 5208.39, 5208.49, 5208.59, 5210.19, 5210.29, 5210.39, 5210.49, 5210.59, 5512.11, 5512.19, 5513.13, 5513.23, 5513.33, an d 55 13.43; (ii) 4]parel goods provided for in subheadir^s 6107.11.00, 6107.12.00, 6109.10.00 and 6109.90.00 if such goods are conposed chiefly of circular knit fabric of yam nuilxr equal to or less than 100 metric nurfaer; and (iii) sweaters provided for in s^iiheading 6110.30 and goods of these stiiheadings that are classified as parts of ensembles in siliieading 6103.23 or 6104.23. (e) Notwithstanding the provisions of siixlivision (b) of this note, the rate of duty in the "Special" sUbcolum of rates of duty colum 1 followed by the synfaol "NX" in parentheses shall not apply to imports from Mexico of apparel goods provided for in stiiheadings 6108.21 and 6108.22 if such goods are conposed chiefly of circular knit fabric of yam nuiter equal to or less than 100 metric nuitier.
