PUBLIC LAW 104-106—FEB. 10, 1996 110 STAT. 241 SEC. 275. MODIFICATION TO UNIVERSITY RESEARCH INITIATIVE SUP- PORT PROGRAM. Section 802 of the National Defense Authorization Act for Fiscal Year 1994 (Public Law 103-160; 107 Stat. 1701) is amended— 10 USC 2358 (1) in subsections (a) and (b), by striking out "shall" both note. places it appears and inserting in lieu thereof "may"; and (2) in subsection (e), by striking out the sentence beginning with "Such selection process". SEC. 276. MANUFACTURING TECHNOLOGY PROGRAM. (a) IN GENERAL.—Section 2525 of title 10, United States Code, is amended as follows: (1) The heading is amended by striking out the second and third words. (2) Subsection (a) is amended— (A) by striking out "Science and"; and (B) by inserting after the first sentence the following: "The Secretary shall use the joint planning process of the directors of the Department of Defense laboratories in establishing the program.". (3) Subsection (c) is amended— (A) by inserting "(1)" after "(c) EXECUTION. —"; and (B) by adding at the end the following: "(2) The Secretary shall seek, to the extent practicable, the participation of manufacturers of manufacturing equipment in the projects under the program.". (4) Subsection (d) is amended— (A) in paragraph (2)— (i) by striking out "or" at the end of subparagraph (A); (ii) by striking out the period at the end of subparagraph (B) and inserting in lieu thereof "; or"; and (iii) by adding at the end the following new subparagraph: "(C) will be carried out by an institution of higher education."; and (B) by adding at the end the following new paragraphs: "(3) At least 25 percent of the funds available for the program each fiscal year shall be used for awarding grants and entering into contracts, cooperative agreements, and other transactions on a cost-share basis under which the ratio of recipient cost to Government cost is two to one. "(4) If the requirement of paragraph (3) cannot be met by July 15 of a fiscal year, the Under Secretary of Defense for Acquisition and Technology may waive the requirement and obligate the balance of the funds available for the program for that fiscal year on a cost-share basis under which the ratio of recipient cost to Government cost is less than two to one. Before implementing any such waiver, the Under Secretary shall submit to the Committee on Armed Services of the Senate and the Committee on National Security of the House of Representatives the reasons for the waiver.".
