USE OF FOREIGN REGISTRY OIL SPILL RESPONSE VESSELS. Notwithstanding any other provision of law, an oil spill response vessel documented under the laws of a foreign country may operate in waters of the United States on an emergency and temporary basis, for the purpose of recovering, transporting, and unloading in a United States port oil discharged as a result of an oil spill in or near those waters, if— (1) an adequate number and type of oil spill response vessels documented under the laws of the United States cannot be engaged to recover oil from an oil spill in or near those waters in a timely manner, as determined by the Federal On-Scene Coordinator for a discharge or threat of a discharge of oil; and (2) that foreign country has by its laws accorded to vessels of the United States the same privileges accorded to vessels of that foreign country under this section. SEC. 1118. JUDICIAL SALE OF CERTAIN DOCUMENTED VESSELS TO ALIENS. Section 31329 of title 46, United States Code, is amended by adding at the end the following new subsection: "(f) This section does not apply to a documented vessel that has been operated only for pleasure.". SEC. 1119. IMPROVED AUTHORITY TO SELL RECYCLABLE MATERIAL. Regulations. Section 641(c)(2) of title 14, United States Code, is amended by inserting before the period the following: ", except that the Commandant may conduct sales of materials for which the proceeds of sale will not exceed $5,000 under regulations prescribed by the Commandant". SEC. 1120. DOCUMENTATION OF CERTAIN VESSELS. (a) GENERAL CERTIFICATES. — Notwithstanding sections 12106, 12107, and 12108 of title 46, United States Code, section 8 of the Act of June 19, 1886 (24 Stat. 81; chapter 421; 46 App. U.S.C. 289), and section 27 of the Merchant Marine Act, 1920 (46 App. U.S.C. 883), as applicable on the date of enactment of this Act, the Secretary of Transportation may issue a certificate of documentation with appropriate endorsement for employment in the coastwise trade for the following vessels: (1) ABORIGINAL (United States official number 942118). (2) ALPHA TANGO (United States official number 945782). (3) ANNAPOLIS (United States official number 999008). (4) ARK (United States official number 912726). (5) AURA (United States official number 1027807). (6) BABS (United States official number 1030028). (7) BAGGER (State of Hawaii registration number HA1809E).
