"(d) Funds made available under this part shall supplement, and not supplant, any Federal, State, or local funds expended by a State or unit of general purpose local government (including an area agency on aging) to provide services described in subsection (a).". SEC. 312. NUTRITION SERVICES. (a) REPEAL.— Subpart 3 of part C of title III of the Older Americans Act of 1965 (42 U.S.C. 3030g -ll et seq.) is repealed. (b) REDESIGNATION. — Part C of title III of the Older Americans Act of 1965 (42 U.S.C. 3030e et seq.) is amended by redesignating subpart 4 as subpart 3, (c) PROGRAM AUTHORIZED.— Section 331(2) of the Older Americans Act of 1965 (42 U.S.C. 3030e(2)) is amended by inserting ", including adult day care facilities and multigenerational me^ sites" before the semi-colon. SEC. 313. NUTRITION REQUIREMENTS. Subpart 4 of part C of title III of the Older Americans Act of 1965 (42 U.S.C. 3030g-21) is amended by striking section 339 and inserting the following: 42 USC 3030g- "SEC. 339. NUTRITION. 21 "A state that establishes and operates a nutrition project under this chapter shall— "(1) solicit the advice of a dietitian or individual with comparable expertise in the planning of nutritional services, and "(2) ensure that the project— "(A) provides meals that— "(i) comply with the Dietary Guidelines for Americans, published by the Secretary and the Secretary of Agriculture, " (ii) provide to each participating older individual— "(I) a minimum of 33^3 percent of the daily recommended dietary allowances as established by the Food and Nutrition Board of the Institute of Medicine of the National Academy of Sciences, if the project provides one meal per day, "(II) a minimum of 66% percent of the allowances if the project provides two meals per day, and "(III) 100 percent of the allowances if the project provides three meals per day, and "(iii) to the maximum extent practicable, are adjusted to meet any special dietary needs of program participants, "(B) provides flexibility to local nutrition providers in designing meals that are appealing to program participants, "(C) encourages providers to enter into contracts that limit the amount of time meals must spend in transit before they are consumed.
