Contracts. (c) CoST SHARING. —Before implementing any project under this section, the Secretary shall enter into a binding agreement with the non-Federal interests. The agreement shall provide that the non-Federal responsibility for the project shall be as follows: (1) To acquire any lands, easements, rights-of-way, relocations, and dredged material disposal areas necessary for implementation of the project. (2) To hold and save harmless the United States free from claims or damages due to implementation of the project, except for the negligence of the Federal Government or its contractors. (3) To pay 35 percent of project costs. (d) NONPROFIT ENTITY. —For any project undertaken under this section, a non-Federal interest may include a nonprofit entity with the consent of the affected local government. (e) AUTHORIZATION OF APPROPRIATIONS.— There is authorized to be appropriated to carry out this section $10,000,000. SEC. 529. LAS VEGAS, NEVADA. (a) DEFINITIONS.—In this section, the following definitions apply: (1) COMMITTEE.— The term "Committee" means the Las Vegas Wash Coordinating Committee. (2) PLAN. —The term "Plan" means the Las Vegas Wash comprehensive adaptive management plan, developed by the Committee and dated January 20, 2000. (3) PROJECT. — The term "Project" means the Las Vegas Wash wetlands restoration and Lake Mead improvement project and includes the programs, features, components, projects, and activities identified in the Plan. (b) PARTICIPATION IN PROJECT. — (1) IN GENERAL. —The Secretary, in conjunction with the Administrator of the Environmental Protection Agency, the Secretary of Agriculture, and the Secretary of the Interior and in partnership with the Committee, shall participate in the implementation of the Project at Las Vegas Wash and Lake Mead in accordance with the Plan. (2) COST SHARING REQUIREMENTS.— (A) IN GENERAL. — The non-Federal interests shall pay 35 percent of the cost of any project carried out under this section. (B) OPERATION AND MAINTENANCE.— The non-Federal interests shall be responsible for all costs associated with operating, maintaining, replacing, repairing, and rehabilitating all projects carried out under this section. (C) FEDERAL LANDS.— Notwithstanding any other provision of this subsection, the Federal share of the cost of a project carried out under this section on Federal lands shall be 100 percent, including the costs of operation and maintenance. (3) AUTHORIZATION OF APPROPRIATIONS. —There is authorized to be appropriated $10,000,000 to carry out this section.
