115 STAT. 836 PUBLIC LAW 107-87—DEC. 18, 2001 ACQUISITION, CONSTRUCTION, AND IMPROVEMENTS For necessary expenses of acquisition, construction, renovation, and improvement of aids to navigation, shore facilities, vessels, and aircraft, including equipment related thereto, $636,354,000, of which $20,000,000 shall be derived from the Oil Spill Liability Trust Fund; of which $89,640,000 shall be avgdlable to acquire, repair, renovate or improve vessels, small boats and related equipment, to remain available until September 30, 2006; $9,500,000 shall be available to acquire new aircraft and increase aviation capability, to remain available until September 30, 2004; $79,293,000 shall be available for other equipment, to remain avsiilable until September 30, 2004; $73,100,000 shall be available for shore facilities and aids to navigation facilities, to remain available until September 30, 2004; $64,631,000 shall be available for personnel compensation and benefits and related costs, to remain available until September 30, 2003; and $320,190,000 shall be available for the Integrated Deepwater Systems program, to remain available until September 30, 2006: Provided, That the Commandant of the Coast Guard is authorized to dispose of surplus real property, by seJe or lease, and the proceeds shall be credited to this appropriation as offsetting collections and made available only for the National Distress and Response System Modernization progreun, to remain available for obligation until September 30, 2004: Provided further, That none of the funds provided under this heading may be obligated or expended for the Integrated Deepwater Systems (IDS) system integration contract until the Secretary or Deputy Secretary of Transportation euid the Director, Office of Management and Budget jointly certify to the House and Senate Committees on Appropriations that funding for the IDS program for fiscal yeEu-s 2003 through 2007, funding for the National Distress and Response System Modernization program to allow for full deploy- ment of s£dd system by 2006, and funding for other essential seeu-ch and rescue procurements, are fully funded in the Coast Guard Capital Investment Plan and within the Office of Management and Budget's budgeteuy projections for the Coast Guard for those yeEU-s: Provided further, That none of the funds provided under this heading may be obligated or expended for the Integrated Deepwater Systems (IDS) integration contract until the Secretary or Deputy Secretary of Transportation and the Director, Office of Management and Budget jointly approve a contingency procurement strategy for the recapitalization of assets and capabilities envisioned in the IDS: Provided further, That upon initi^ submission to the Congress of the fiscal year 2003 President's budget, the Secretary of Transportation shall transmit to the Congress a comprehensive capital investment plan for the United States Coast Gu£U"d which includes funding for each budget line item for fiscal years 2003 through 2007, with total funding for each year of the plan constrained to the funding targets for those years as estimated and approved by the Office of Management and Budget: Provided further, That the Eunount herein appropriated shall be reduced by $100,000 per day for each day after initial submission of the President's budget that the plan has not been submitted to the Congress: Provided further. That the Director, Office of Management and Budget shall submit the budget request for the IDS integration
