Subtitle A—Duties and Functions of Department of Defense Officers SEC. 901. UNDER SECRETARY OF DEFENSE FOR INTELLIGENCE. (a) ESTABLISHMENT OF POSITION. —Chapter 4 of title 10, United States Code, is amended— (1) by transferring section 137 within such chapter to appear after section 139 and redesignating that section as section 139a; and (2) by inserting after section 136a the following new section 137: "§ 137. Under Secretary of Defense for Intelligence "(a) There is an Under Secretary of Defense for Intelligence, appointed from civilian life by the President, by and with the advice and consent of the Senate. "(b) Subject to the authority, direction, and control of the Secretary of Defense, the Under Secretary of Defense for Intelligence shall perform such duties and exercise such powers as the Secretary of Defense may prescribe in the area of intelligence. "(c) The Under Secretary of Defense for Intelligence takes precedence in the Department of Defense after the Under Secretary of Defense for Personnel and Readiness.". (b) CONFORMING AMENDMENTS.— (1) Section 131(b) of such title is amended— (A) by striking paragraphs (2) through (5) and inserting the following: "(2) The Under Secretaries of Defense, as follows: "(A) The Under Secretary of Defense for Acquisition, Technology, and Logistics. "(B) The Under Secretary of Defense for Policy. "(C) The Under Secretary of Defense (Comptroller). "(D) The Under Secretary of Defense for Personnel and Readiness. "(E) The Under Secretary of Defense for Intelligence."; and (B) by redesignating paragraphs (6), (7), (8), (9), (10), and (11) as paragraphs (3), (4), (5), (6), (7), and (8), respectively. (2) The table of sections at the beginning of chapter 4 of such title is amended— (A) by striking the item relating to section 137 and inserting the following: "137. Under Secretary of Defense for Intelligence."; and
