That the amount provided under this heading is designated as an emergency requirement pursuant to section 402 of H. Con. Res. 95 (109th Congress), the concurrent resolution on the budget for fiscal year 2006. SEC. 7009. Unexpended balances for Health Resources and Services Administration grant number 7C6HF03601–01–00, appropriated in Public Law 106–554, shall remain available until September 30, 2009. SEC. 7010. For an additional amount for ‘‘Department of Health and Human Services, Centers for Disease Control and Prevention, Disease Control, Research and Training’’, to carry out section 501 of the Federal Mine Safety and Health Act of 1977, $10,000,000 for research to develop mine safety technology: Provided, That progress reports on technology development shall be submitted to the House and Senate Committees on Appropriations and the Committee on Health, Education, Labor and Pensions of the Senate and the Committee on Education and the Workforce of the House on a quarterly basis, with the first report due July 15, 2006: Provided further, That the amount provided under this heading shall remain available until September 30, 2007: Provided further, That the amount provided under this heading is designated as an emergency requirement pursuant to section 402 of H. Public Law 109–149 (119 Stat. 2876) under the heading ‘‘Railroad Retirement Board, Dual Benefits Payments Account’’ is amended by striking ‘‘to the amount by which the product of recipients and the average benefit received exceeds $97,000,000’’ and inserting ‘‘to the amount by which the product of recipients and the average benefit received exceeds the amount available for payment of vested dual benefits’’ in lieu thereof. SEC. 7012. Section 224 of Public Law 109–149 (119 Stat. 2862) is amended by striking ‘‘June’’ and inserting ‘‘December’’ in lieu thereof. SEC. 7013. None of the funds appropriated in Public Law 109– 149 or prior Acts under the heading ‘‘Employment and Training Administration’’ that are available for expenditure on or after the date of enactment of this section shall be used by a recipient or subrecipient of such funds to pay the salary and bonuses of an individual, either as direct costs or indirect costs, at a rate in excess of Executive Level II, except as provided for under section 101 of Public Law 109–149. This limitation shall not apply to vendors providing goods and services as defined in OMB Circular A–133. Where States are recipients of such funds, States may establish a lower limit for salaries and bonuses of those receiving salaries and bonuses from subrecipients of such funds, taking into account factors including the relative cost-of-living in the State, the compensation levels for comparable State or local government employees, and the size of the organizations that administer Federal programs involved including Employment and Training Administration programs. SEC. 7014. Any national service educational award described in subtitle D of title I of the National and Community Service Act of 1990 (42 U.S.C. 12601 et seq.), made with funds appropriated to, funds transferred to, or interest accumulated in the National Service Trust, shall hereafter be known as a ‘‘Segal AmeriCorps Education Award’’.
