AUTHORI T Y TOI MP OSE REASO N A BL E RESTRICTIONS ON PAYMENT O F FULL REPLACEMENT V ALUE FOR LOST OR D AMA G ED PERSONAL PROPERTY TRANSPORTED AT GOVERNMENT E X PENSE. Section 26 3 6a(d) of title 10, United States Code, is amended by adding at the end the following new sentence: ‘‘The regulations may include a re q uirement that a member of the armed forces or civilian employee of the D epartment of Defense comply with reasonable restrictions or conditions prescribed by the Secretary in order to receive the full amount deducted under subsection (b).’’. SEC. 37 4 . PRIORITY TRANSPORTATION ON DEPARTMENT OF DEFENSE AIRCRAFT OF RETIRED MEMBERS RESIDING IN COMMON -W EALTHS AND POSSESSIONS OF THE UNITED STATES FOR CERTAIN HEALTH CARE SERVICES. (a) A VAIL A B ILI TY OF TRANS P ORTATION.—Chapter 157 of title 10, United States Code, is amended by inserting after section 2641a the following new section: ‘ ‘ §2641b.Space- a v a il able tr avel onD epart m ent o f Defen s e aircraft
retire d members residin g in C ommon- w ealt h s and possessions of the U nited States for certain health care services ‘‘(a) PRIORITY TRANSPORTATION.—The Secretary of Defense shall provide transportation on Department of Defense aircraft on a space-available basis for any member or former member of the uniformed services described in subsection (b), and a single dependent of the member if needed to accompany the member, at a priority level in the same category as the priority level for an unaccompanied dependent over the age of 18 traveling on environmental and morale leave. ‘‘(b) E LI G IBLE M E M BERS AND FORMER MEMBERS.—A member or former member eligible for priority transport under subsection (a) is a covered beneficiary under chapter 55 of this title who— ‘‘(1) is entitled to retired or retainer pay; ‘‘(2) resides in or is located in a Commonwealth or posses- sion of the United States; and ‘‘(3) is referred by a military or civilian primary care pro- vider located in that Commonwealth or possession to a specialty care provider for services to be provided outside of that Commonwealth or possession. ‘‘(c) SCOPE OF PRIORITY.—The increased priority for space-avail- able transportation required by subsection (a) applies with respect to both— Ap p licab ili ty.
