( a ) S ECTION53 02. — Section 5302(a)( 1 0) of title 49 , United States Code, is a m ended by stri k ing ‘‘charter,’’ and inserting ‘‘charter, sightseeing,’’. (b) SECTION 5303.— (1) Section 5303(f)(3)(C)(ii) of such title is amended by striking subclause ( I I) and inserting the follo w ing: ‘‘(II) F U N D IN G .—For fiscal year 2008 and each fiscal year thereafter, in addition to other funds made a v ailable to the metropolitan planning organi z ation for the Lake Tahoe region under this chapter and title 23, prior to any allocation under section 202 of title 23, and notwithstanding the allocation provisions of section 202, the Secretary shall set aside 1⁄2 of 1 percent of all funds author - ized to be appropriated for such fiscal year to carry out section 204 of title 23, and shall make such funds available to the metropolitan planning organization for the Lake Tahoe region to carry out the transportation planning process, environ- mental reviews, preliminary engineering, and design to complete environmental documentation for transportation pro j ects for the Lake Tahoe region under the Tahoe R egional P lanning Com- pact as consented to in Public Law 9 6 –551 (94 Stat. 3233) and this paragraph.’’. (2) Section 5303(j)(3)( D ) of such title is amended— (A) by inserting ‘‘or the identified phase’’ before ‘‘within the time’’
and ( B ) by inserting ‘‘or the identified phase’’ before the period at the end. (3) Section 5303(k)(2) of such title is amended by striking ‘‘a metropolitan planning area serving’’. (c) SECTION 530 7 .—Section 5307(b) of such title is amended— (1) in the heading for paragraph (2) by striking ‘‘ 20 0 7 ’’ and inserting ‘‘200 9 ’’; (2) in paragraph (2)(A)— (A) by striking ‘‘2007’’ and inserting ‘‘2009’’; and (B) by striking ‘‘mass’’ and inserting ‘‘public’’; (3) by adding at the end of paragraph (2) the following: ‘‘(E) MAX I M UM AMOUNT S IN F ISCA LY EA R S 200 8 AND 2009.—In fiscal years 2008 and 2009— ‘‘(i) amounts made available to any urbanized area under clause (i) or (ii) of subparagraph (A) shall be not more than 50 percent of the amount apportioned in fiscal year 2002 to the urbanized area with a popu- lation of less than 200,000, as determined in the 1990 decennial census of population; ‘‘(ii) amounts made available to any urbanized area under subparagraph (A)(iii) shall be not more than
