12 2 STA T . 1 56PUBLIC LA W 11 0– 1 8 1 —J A N .28 , 2008 ‘ ‘ (f) ( 1 ) Whend e t e rmi ned by the S e c ret a ry o fthemi l itary de p art - ment concerned to be in the national intere s tanda g reed u pon by the institution concerned , the institution may reimburse a J unior R eser v e O fficers ’T raining C orps instructor for moving e x penses incurred by the instructor to accept employment at the institution in a position that the Secretary concerned determines is hard- to-fill for geographic or economic reasons . ‘‘( 2 ) A s a condition on providing reimbursement under para- graph (1), the institution shall re q uire the instructor to execute a w ritten agreement to serve a minimum of two years of employ- ment at the institution in the hard-to-fill position. ‘‘( 3 ) Any reimbursement provided to an instructor under para- graph (1) is in addition to the minimum instructor pay otherwise payable to the instructor. ‘‘( 4 ) The Secretary concerned shall reimburse an institution providing reimbursement to an instructor under paragraph (1) in an amount equal to the amount of the reimbursement paid by the institution under that paragraph. Any reimbursement provided by the Secretary concerned shall be provided from funds appro- priated for that purpose. ‘‘( 5 ) The provision of reimbursement under paragraph (1) or (4) shall be sub j ect to regulations prescribed by the Secretary of D efense for purposes of this subsection.’’. (a) EXPANDE DE LIG I B ILI TYFOR C H APTER 6 1 M ILITARY RETIREE S . — Subsection (c) of section 1413a of title 1 0 , U nited States Code, is amended by stri k ing ‘‘entitled to retired pay who—’’ and all that follows and inserting ‘‘who— ‘‘(1) is entitled to retired pay (other than by reason of section 12 7 31b of this title)

and ‘‘(2) has a combat-related disability.’’. (b) CO M P U TATION.— P aragraph (3) of subsection (b) of such sec- tion is amended— (1) by striking ‘‘ I n the case of’’ and inserting the following

‘‘(A) G ENERAL RULE.—In the case of’’; and (2) by adding at the end the following new subparagraph: ‘‘( B ) SPE C IAL RULE FOR RETIREES W ITH FEWER THAN 20 YEARS OF SER V ICE.—In the case of an eligible combat- related disabled uniformed services retiree who is retired under chapter 61 of this title with fewer than 20 years of creditable service, the amount of the payment under paragraph (1) for any month shall be reduced by the amount (if any) by which the amount of the member’s retired pay under chapter 61 of this title exceeds the amount equal to 2 1⁄2 percent of the member’s years of creditable service multiplied by the member’s retired pay base under section 1406(b)(1) or 1407 of this title, which- ever is applicable to the member.’’. (c) EFFECTIVE DATE.—The amendments made by this section shall take effect on January 1, 200 8 , and shall apply to payments for months beginning on or after that date.
