‘(g) P ROHIB I T IO N . —N otwithstanding any other p ro v ision of law (including regulations) , the Secretary may not re q uire a State or local agency to prioriti z e assistance to a particular group of individ - uals that are— ‘‘(1) low-income persons aged 6 0 and older; or ‘‘(2) women, infants, and children. ’ ’. PART I V —SENIOR FARMERS ’ MAR K ET NUTRITION PROGRAM SEC. 42 3 1. SENIORS FARMERS ’ MAR K ET NUTRITION PROGRAM. Section 4 402 of the F arm Security and R ural I nvestment Act of 2002 (7 U.S.C. 3007) is amended— (1) in subsection (b)(1), by inserting ‘‘honey,’’ after ‘‘vegeta- bles,’’; (2) by striking subsection (c) and inserting the following: ‘‘(c) EXCLUS ION O FBE NEFITS IN D ETER M ININ G ELIGIBILIT Y FOR O THER PROGR A MS.— T he value of any benefit provided to any eligible seniors farmers’ market nutrition program recipient under this section shall not be considered to be income or resources for any purposes under any Federal, State, or local law.’’; and (3) by adding at the end the following: ‘‘(d) PROHIBITION ON COLLECTION OF SALES TAX.—Each State shall ensure that no State or local ta x is collected within the State on a purchase of food with a benefit distributed under the seniors farmers’ market nutrition program. ‘‘(e) REGULATIONS.—The Secretary may promulgate such regula- tions as the Secretary considers to be necessary to carry out the seniors farmers’ market nutrition program.’’. Subti t leC— C h il dN ut r iti ona nd R elated P ro g ra ms SEC. 43 0 1. STATE PERFORMANCE ON ENROLLING C H ILDREN RECEI V ING PROGRAM B ENEFITS FOR FREE SCHOOL MEALS. (a) IN G ENERAL.—Not later than December 31, 2008 and J une 30 of each year thereafter, the Secretary shall submit to the Committees on Agriculture and Education and Labor of the H ouse of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that assesses the effectiveness of each State in enrolling school-aged children in households receiving program benefits under the Food and Nutrition Act of 2008 (7 U.S.C. 2011 et seq.) (referred to in this section as ‘‘program benefits’’) for free school meals using direct certification.
