( 3 )an y recommendations of the S ecretary regarding the integration of whole grain products in the school lunch and breakfast programs; and ( 4 ) an evaluation of any other outcomes determined to be appropriate by the Secretary . (e) REPORT . —A s soon as practicable after the completion of the evaluation under subsection (d) , the Secretary shall submit to the C ommittee on Agriculture, N utrition, and F orestry of the Senate and the Committee on E ducation and L abor of the H ouse of Representative a report describing the results of the evaluation. SEC.4306 . BUYAM E RI CA N RE Q UIREMEN T S. (a) F IND IN GS .— T he Congress finds the following

( 1 ) Federal law re q uires that commodities and products purchased with Federal funds be, to the e x tent practicable, of domestic origin. (2) Federal B uy American statutory requirements seek to ensure that purchases made with Federal funds benefit domestic producers. (3) The Richard B. Russell National School Lunch Act (42 U .S.C. 1 75 1 et seq.) requires the use of domestic food products for all meals served under the program, including food products purchased with local funds. (b) B UY A M ERI CA N STATUTORY RE Q UIREMENTS.—The D epart - ment of Agriculture should undertake training, guidance, and enforcement of the various current Buy American statutory require- ments and regulations, including those of the Richard B. Russell National School Lunch Act (42 U.S.C. 1751 et seq.). SEC. 430 7 . SUR V EY OF FOO D S P URC H ASED BY SCHOO L FOOD AUTHORI - TIES. (a) I N G ENERA L .—For fiscal year 2 0 0 9 , the Secretary shall carry out a nationally representative survey of the foods purchased during the most recent school year for which data is available by school authorities participating in the school lunch program established under the Richard B. Russell National School Lunch Act (42 U.S.C. 1751 et seq.). (b) REPORT.— (1) IN GENERAL.— O n completion of the survey, the Sec- retary shall submit to the Committees on Agriculture and Edu- cation and Labor of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes the results of the survey. (2) INTERIM REQUIREMENT.—If the initial report required under paragraph (1) is not submitted to the Committees referred to in that paragraph by J une 30, 2009, the Secretary shall submit to the Committees an interim report that describes the relevant survey data, or a sample of such data, available to the Secretary as of that date. (c) FUNDING.—Of the funds of the Commodity Credit Corpora- tion, the Secretary shall use to carry out this section not more than $ 3,000,000. 7USC2 2 08note.
