‘(b) OPERATION A SN ONAPPROPRIATE DFU ND I NSTRU M EN - TA L IT Y.— ‘‘( 1 ) C EASE OPERATIONS.—Not later than October 1 , 2 0 0 9 , the S ecretary of A griculture shall cease to m aintain or o p erate a nonappropriated fund instrumentality of the U nited States to de v elop, administer, or provide educational training and professional development activities, including educational activities for Federal agencies, Federal employees, non-profit organi z ations, other entities, and members of the general public. ‘‘(2) T RANSITION.— ‘‘(A) IN G ENERAL.—The Secretary of Agriculture is authorized to use funds available to the D epartment of Agriculture and such resources of the Department as the Secretary considers appropriate (including the assignment of such employees of the Department as the Secretary considers appropriate) to assist the G eneral Administrative B oard of the Graduate School in the conversion of the Graduate School to an entity that is non-governmental and not a nonappropriated fund instrumentality of the United States, including such privatization activities not otherwise inconsistent with law or regulation. ‘‘(B) TERMINATION O F AUT H ORITY.—The authority under paragraph (1) shall terminate on the earlier of— ‘‘(i) the completion of the transition of the Graduate School to an entity that is non-governmental and not a nonappropriated fund instrumentality of the United States, as determined by the Secretary
or ‘‘(ii) September 3 0, 2009. ’ ’. (b) P RO C UREMENT PROCEDURES.—Notwithstanding the amend- ments made by subsection (a), effective on the date of the enactment of this Act, the Graduate School of the Department of Agriculture shall be sub j ect to Federal procurement laws and regulations in the same manner and subject to the same re q uirements as a private entity providing services to the Federal Government. SEC. 1 4 214. FINES FOR VIOLATIONS OF T H E ANIMAL W ELFARE ACT. Section 19(b) of the Animal W elfare Act ( 7 U.S.C. 21 4 9(b)) is amended in the first sentence by striking ‘‘not more than $ 2, 5 00 for each such violation’’ and inserting ‘‘not more than $10,000 for each such violation’’. SEC. 1421 5 . DEFINITION OF CENTRAL FILING S Y STEM. Section 1324(c)(2) of the Food Security Act of 19 8 5 (7 U.S.C. 1 6 31(c)(2)) is amended— (1) in subparagraph (C)(ii)(II), by inserting after ‘‘such debtors’’ the following: ‘‘, e x cept that the numerical list con- taining social security or taxpayer identification numbers may be encrypted for security purposes if the Secretary of State provides a method by which an effective search of the encrypted numbers may be conducted to determine whether the farm product at issue is subject to 1 or more liens’’; and (2) in subparagraph ( E )— Ef f ectiv e da te .7USC2 27 9bno te.
