12 2 STA T . 22 35PUBLIC LA W 11 0– 2 46—J U NE 1 8, 2008 ‘ ‘ (4)EF F ECTONAS S I STANCE .—ASta t e’s s h a r e of a dmin istra - ti v ee xp enses of a C ommission u nder this su b se c tion sha l l not be ta k en into consideration w hen determinin g the amount of assistance provided to the State under this subtitle. ‘ ‘ §1530 5 .Me e tings ‘‘(a) I NITIA LM EETIN G .—Each Commission shall hold an initial meeting not later than 180 da y s after the date of the enactment of this section. ‘‘(b) ANN U AL MEETING.—Each Commission shall conduct at least 1 meeting each year with the F ederal Cochairperson and at least a ma j ority of the State members present. ‘‘(c) A D DITIONAL MEETINGS.—Each Commission shall conduct additional meetings at such times as it determines and may conduct such meetings by electronic means. ‘‘§ 1530 6 . P e r s o n alf inan c ial interests ‘‘(a) CONFLICTS OF INTE R EST.— ‘‘(1) N O ROLE ALLO W ED.—Except as permitted by paragraph ( 2 ) , an individual who is a State member or alternate, or an officer or employee of a Commission, shall not participate personally and substantially as a member, alternate, officer, or employee of the Commission, through decision, approval, disapproval, recommendation, re q uest for a ruling, or other determination, contract, claim, controversy, or other matter in which, to the individual’s knowledge, any of the following has a financial interest
‘‘(A) T he individual. ‘‘( B ) The individual’s spouse, minor child, or partner. ‘‘(C) An organi z ation (except a State or political subdivi- sion of a State) in which the individual is serving as an officer, director, trustee, partner, or employee. ‘‘( D ) Any person or organization with whom the indi- vidual is negotiating or has any arrangement concerning prospective employment. ‘‘(2) E X CE P TION.— P aragraph (1) shall not apply if the indi- vidual, in advance of the proceeding, application, request for a ruling or other determination, contract, claim controversy, or other particular matter presenting a potential conflict of interest— ‘‘(A) advises the Commission of the nature and cir- cumstances of the matter presenting the conflict of interest
‘‘(B) makes full disclosure of the financial interest; and ‘‘(C) receives a written decision of the Commission that the interest is not so substantial as to be considered likely to affect the integrity of the services that the Commission may expect from the individual. ‘‘( 3 ) V IOLATION.—An individual violating this subsection shall be fined under title 18, imprisoned for not more than 1 year, or both. ‘‘(b) STATE ME MB ER OR ALTERNATE.—A State member or alter- nate member may not receive any salary, or any contribution to, or supplementation of, salary, for services on a Commission from a source other than the State of the member or alternate. ‘‘(c) DETAILED EMPLO Y EES.— Deadlin e .
