(a) IN G E NE RAL . — Subtitle C of the Federal H ousing Enterprises Financial Safety and Soundness Act of 1 9 9 2 (12 U.S.C. 4 6 31 et seq.) is amended by inserting after section 1377, as added by this Act, the following

‘SEC. 1 378 . CRIMINAL PENALTY. ‘‘ W hoe v er, being subject to an order in effect under section 1377, without the prior written approval of the Director, knowingly participates, directly or indirectly, in any manner (including by engaging in an activity specifically prohibited in such an order) in the conduct of the affairs of any regulated entity shall, notwith- standing section 3571 of title 1 8 , be fined not more than $ 1, 0 00,000, imprisoned for not more than 5 years, or both.’’. (b) T E CH N I CAL AN D C O N F OR M IN G AMENDMEN TS .—The Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (12 U.S.C. 4501 et seq.) is amended— (1) in section 1379 (as so designated by this Act)— (A) by striking ‘‘an enterprise’’ and inserting ‘‘a regu- lated entity’’; and (B) by striking ‘‘the enterprise’’ and inserting ‘‘the regu- lated entity’’; (2) in section 1379A (as so designated by this Act), by striking ‘‘an enterprise’’ and inserting ‘‘a regulated entity’’; (3) in section 1379B(c) (as so designated by this Act), by striking ‘‘enterprise’’ and inserting ‘‘regulated entity’’; and (4) in section 1379D (as so designated by this Act), by striking ‘‘enterprise’’ and inserting ‘‘regulated entity’’. SEC. 1157. N O TICE A F TER SEPARATION FROM SER V ICE. Section 1379 of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (12 U.S.C. 4637), as so designated by this Act, is amended— (1) by striking ‘‘2-year’’ and inserting ‘‘6-year’’; (2) by striking ‘‘a director or e x ecutive officer of an enter- prise’’ and inserting ‘‘an entity-affiliated party’’; (3) by striking ‘‘director or officer’’ each place that term appears and inserting ‘‘entity-affiliated party’’; and (4) by striking ‘‘enterprise.’’ and inserting ‘‘regulated entity.’’. 12USC46 41 . 12 USC 46 39 . 12 USC 463 8 . 12 USC 463 7 . 12 USC 4636 b .
