A DMIN I STRA T O R .—T h e te rm‘ ‘A d ministr a t o r ’ ’ means the Administrator o f the E n v ironmenta lP rotection A g enc y . ( 2 ) C O VE RED VESSE L .—The term ‘‘covered vessel’’ means a vessel that is— (A) less than 79 feet in length

or ( B ) a fishing vessel (as defined in section 21 0 1of title 46,U nited S tates Code), regardless of the length of the vessel. ( 3 ) O T H ER TERMS.—The terms ‘‘contig u ous z one’’, ‘‘dis - charge’’, ‘‘ocean’’, and ‘‘State’’ have the meanings given the terms in section 5 02 of the F ederal W ater Pollution Control Act (33 U.S.C. 1362). SEC. 2 . DISC HARG ES INCIDENTA L TO NOR M ALO P ERATION OF V ES - SELS. (a) N O PERMIT R E QU IREMENT.—E x ce p t as provided in su b - section (b), during the 2-year period beginning on the date of enact- ment of this Act, the Administrator, or a State in the case of a permit program approved under section 402 of the Federal Water Pollution Control Act (33 U.S.C. 1342), shall not re q uire a permit under that section for a covered vessel for— (1) any discharge of effluent from properly functioning marine engines; (2) any discharge of laundry, sho w er, and galley sin k wastes; or (3) any other discharge incidental to the normal operation of a covered vessel. (b) E XC E P TIONS.—Subsection (a) shall not apply with respect to— (1) rubbish, trash, garbage, or other such materials dis- charged overboard; (2) other discharges when the vessel is operating in a capacity other than as a means of transportation, such as when— (A) used as an energy or mining facility; Timep e r i od.3 3 USC1 3 42n o t e. 33 USC 1342 note.
