and ‘‘(ii) such other information and assurances as the S ecretary may reasonably re q uire . ‘‘( 3 )S PECIALRU LE S . — ‘‘(A) E LI G I B ILI TY .—No Native American-serving, non- tribal institution that receives funds under this section shall concurrently receive funds under any other provision of this part, part B , orpartAoftitle V . ‘‘(B) E X E M PTI ON .—Section 3 1 3(d) shall not apply to institutions that are eligible to receive funds under this section. ‘‘( C ) D ISTRIBUTION.— I n awarding grants under this sec- tion, the Secretary shall, to the e x tent possible and con- sistent with the competitive process under which such grants are awarded, ensure maximum and equitable dis- tribution among all eligible institutions. ‘‘(D) M INIMUM GRANT AMOUNT.— T he minimum amount of a grant under this section shall be $20 0,000. ’ ’. SEC.307 . A SS I S T A N CET O ASIAN A M E R ICAN AN D NATI V E AMERICAN P ACI F IC IS L ANDER - SERVIN G INSTIT U TIONS. P art A of title III (20 U .S.C. 10 57 et seq.) is amended by adding after section 31 9 (as added by section 30 6 of this Act) the following

‘SEC. 3 2 0. ASIAN AMERICAN AND NATIVE AMERICAN PACIFIC ISLANDER-SERVING INSTITUTIONS. ‘‘(a) PROGRAM AUT H ORI Z E D .—The Secretary shall provide grants and related assistance to Asian American and Native American Pacific Islander-serving institutions to enable such institutions to improve and expand their capacity to serve Asian Americans and Native American Pacific Islanders and low-income individuals. ‘‘(b) DE F INITIONS.—In this section: ‘‘(1) ASIAN AMERICAN.—The term ‘Asian American’ has the meaning given the term ‘Asian’ in the O ffice of Management and Budget’s Standards for Maintaining, Collecting, and Pre- senting F ederal Data on R ace and Ethnicity as published on October 30, 1997 (62 Fed. Reg. 5 8 789). ‘‘(2) ASIAN AMERICAN AND NATI V E AMERICAN PACIFIC ISLANDER-SERVING INSTITUTION.—The term ‘Asian American and Native American Pacific Islander-serving institution’ means an institution of higher education that— ‘‘(A) is an eligible institution under section 312(b); and ‘‘(B) at the time of application, has an enrollment of undergraduate students that is not less than 10 percent students who are Asian American or Native American Pacific Islander. ‘‘(3) NATIVE AMERICAN PACIFIC ISLANDER.—The term ‘Native American Pacific Islander’ means any descendant of the aboriginal people of any island in the Pacific Ocean that is a territory or possession of the United States. ‘‘(c) AUTHORIZED ACTIVITIES.— ‘‘(1) TYPES OF ACTIVITIES AUTHORIZED.— G rants awarded under this section shall be used by Asian American and Native American Pacific Islander-serving institutions to assist such Grants.20USC1 0 59g .
