12 2 STA T .3 223 PUBLIC LA W 11 0– 31 5— AU G .1 4, 200 8wer e notl e s st ha nthea m o u nte xp en d ed per student or the a g gre - gate expend i ture by the S tate f orthea c ti v ities for the second preceding fiscal year .‘ ‘ ( i ) S PECIALRU LE. —N otwithstanding subsection (h) , for pur- poses of determining a State ’ s share of the cost of the authori z ed activities described in subsection (d), the State shall consider only those expenditures from non- F ederal sources that exceed the State’s total expenditures for need-based grants, scholarships, and wor k - study assistance for fiscal year 19 99 (including any such assistance provided under this subpart). ‘‘( j ) CONT INUATION AN DTR AN S ITION.—For the two-year period that begins on the date of enactment of the H igher E ducation O pportunity A ct, the Secretary shall continue to award grants under section 4 1 5 E of the Higher Education Act of 19 6 5 as such section existed on the day before the date of enactment of the Higher Education Opportunity Act to States that choose to apply for grants under such predecessor section. ‘‘(k) REPORTS.—Not later than three years after the date of enactment of the Higher Education Opportunity Act and annually thereafter, the Secretary shall submit a report describing the activi- ties and the impact of the partnerships under this section to the authorizing committees.’’. SEC.408 .S P EC IAL P ROG RA M S F ORS TUD E N TS WH OSE FAMILIES ARE ENGAGED IN MIGRANT AND SEASONAL FARMWOR K . Section 41 8 A( 20U .S.C. 10 7 0d – 2) is amended— (1) in subsection (b)— (A) in paragraph (1)( B )(i), by striking ‘‘parents’’ and inserting ‘‘immediate family’’

(B) in paragraph ( 3 )(B), by inserting ‘‘(including preparation for college entrance examinations)’’ after ‘‘col- lege program’’; (C) in paragraph (5), by striking ‘‘weekly’’; ( D ) in paragraph (7), by striking ‘‘and’’ after the semi- colon; (E) in paragraph (8)— (i) by inserting ‘‘(such as transportation and child care)’’ after ‘‘services’’; and (ii) by striking the period at the end and inserting ‘‘; and’’; and (F) by adding at the end the following

‘‘(9) other activities to improve persistence and retention in postsecondary education.’’; (2) in subsection (c)— (A) in paragraph (1)— (i) in subparagraph (A)— ( I ) by striking ‘‘parents’’ and inserting ‘‘imme- diate family’’; and (II) by striking ‘‘(or such part’s predecessor authority)’’; (ii) in subparagraph (B)— (I) in the matter preceding clause (i), by inserting ‘‘to improve placement, persistence, and retention in postsecondary education,’’ after ‘‘serv- ices’’; and Ef f ectiv e da te .
