(b) EFFECTI V E DATE.—The amendments made by subsection (a) shall ta k e effect on J uly 1 ,2 0 10, e x cept that the amendments made by paragraphs (3), (4), and ( 8 ) of such subsection shall take effect on the date of enactment of this A ct. SEC.486 .S TA T U TE OFLIM ITATIO N SAN D STATE COU R T J UD G MENTS. Section 484A (20 U .S. C .10 9 1a) is amended— (1) in subsection (b)— (A) in paragraph (1), by striking ‘‘and’’ after the semi- colon

( B ) in paragraph (2), by striking the period and inserting ‘‘; and’’; and (C) by adding at the end the following

‘‘(3) in collecting any obligation arising from a loan made under part E, an institution of higher education that has an agreement with the Secretary pursuant to section 4 6 3(a) shall not be sub j ect to a defense raised by any borrower based on a claim of infancy.’’; and (2) by adding at the end the following: ‘‘(d) SPECIAL RULE.—This section shall not apply in the case of a student who is deceased, or to a deceased student’s estate or the estate of such student’s family. I f a student is deceased, then the student’s estate or the estate of the student’s family shall not be re q uired to repay any financial assistance under this title, including interest paid on the student’s behalf, collection costs, or other charges specified in this title.’’. SEC. 48 7 . READMISSION RE Q UIREMENTS FOR SER V ICEMEM B ERS. P art G of title I V (20 U.S.C. 1088 et seq.) is amended by inserting after section 484B the following: ‘ ‘SEC. 484C. READMISSION REQUIREMENTS FOR SERVICEMEMBERS. ‘‘(a) DEFINITION OF SERVICE IN T H E UNIFORMED SERVICES.— In this section, the term ‘service in the uniformed services’ means service (whether voluntary or involuntary) on active duty in the Armed Forces, including such service by a member of the N ational Guard or Reserve, for a period of more than 30 days under a call or order to active duty of more than 30 days. ‘‘(b) DISCRIMINATION AGAINST STUDENTS W HO SERVE IN THE UNIFORMED SERVICES PROHI B ITED.—A person who is a member of, applies to be a member of, performs, has performed, applies to perform, or has an obligation to perform, service in the uniformed services shall not be denied readmission to an institution of higher 20USC1 0 9 1 c. 20 USC 1091 note .
