12 2 STA T .34 1 0PUBLIC LA W 110 – 31 5— AU G .14 , 200 8‘ ‘ (3)Co o rdinat in gw it h a p propriat el o c al entitie sf or the pro v ision of m ental health services for st u dents and staff of the institution of higher education or consortium , including mental health crisis response and intervention services for stu - dents and staff affected by a campus or community emergency . ‘‘(d) AP P LICAT I ON . —E ach institution of higher education or consortium desiring a grant under this section shall submit an application to the S ecretary at such time, in such manner, and containing such information as the Secretary may re q uire. ‘‘(e) TE C H NICAL A S SISTANCE.—The Secretary shall coordinate technical assistance provided by State and local emergency manage- ment agencies, the D epartment of H omeland Security, and other agencies as appropriate, to institutions of higher education or con- sortia that request assistance in developing and implementing the activities assisted under this section. ‘‘(f) A U THO R I Z ATION O F APPROPRIATIONS.—There are authori z ed to be appropriated to carry out this part such sums as may be necessary for fiscal year 20 0 9 and each of the five succeeding fiscal years. ‘ ‘ SEC.82 2. MOD E L EME RG E N C Y RES P ONSE POL I CIES , PROCED U RES, A ND PRAC T ICES. ‘‘The Secretary, in consultation with the Attorney G eneral and the Secretary of Homeland Security, shall continue to— ‘‘( 1 ) advise institutions of higher education on model emer- gency response policies, procedures, and practices

and ‘‘(2) disseminate information concerning those policies, procedures, and practices. ‘‘SEC. 82 3 . PREPARATION F OR FUTURE DISASTERS PLAN B YT H E SEC - RETARY. ‘‘The Secretary shall continue to coordinate with the Secretary of Homeland Security and other appropriate agencies to develop and maintain procedures to address the preparedness, response, and recovery needs of institutions of higher education in the event of a natural or manmade disaster with respect to which the P resi- dent has declared a ma j or disaster or emergency (as such terms are defined in section 8 2 4 ). ‘‘SEC. 82 4 . EDUCATION DISASTER AND EMERGENCY RELIEF LOAN PRO- GRAM. ‘‘(a) PRO G RA M AUTHORIZE D .—The Secretary, in consultation with the Secretary of Homeland Security, is authorized to establish an Education Disaster and Emergency R elief L oan Program for institutions of higher education impacted by a major disaster or emergency declared by the President. ‘‘(b) U SE OF ASSISTANCE.—The Secretary shall, subject to the availability of appropriations, provide loans under this section to institutions of higher education after the declaration of a major disaster or emergency by the President. Loan funds provided under this section may be used for construction, replacement, renovation, and operations costs resulting from a major disaster or emergency declared by the President. ‘‘(c) APPLICATION RE Q UIREMENTS.—To be considered for a loan under this section, an institution of higher education shall— ‘‘(1) submit a financial statement and other appropriate data, documentation, or evidence requested by the Secretary that indicates that the institution incurred losses resulting 20USC1 1 6 1 l–3. 20 USC 1161l–2.
