38 U .S.C. 7333 note) is repealed. SEC. 40 8 . PROVISION OF COMPREHENSIVE HEALTH CARE B Y SEC- RETARY OF VETERANS AFFAIRS TO CHILDREN OF VIETNAM VETERANS BORN WITH SPINA BIFIDA. (a) PR OV I S ION O F COM P RE H ENSIVE H EALTH CARE.—Section 1803(a) is amended by stri k ing ‘ ‘such health care as the Secretary determines is needed by the child for the spina bifida or any disability that is associated with such condition’’ and inserting ‘‘health care under this section’’. (b) E FFECTIVE D ATE.—The amendment made by subsection (a) shall apply with respect to care furnished after the date of the enactment of this Act. SEC. 40 9 . E X EMPTION FROM COPAYMENT RE Q UIREMENT FOR VET- ERANS RECEIVING HOSPICE CARE. Section 1710 is amended— (1) in subsection (f)(1), by inserting ‘‘(e x cept if such care constitutes hospice care)’’ after ‘‘nursing home care’’; and (2) in subsection (g)(1), by inserting ‘‘(except if such care constitutes hospice care)’’ after ‘‘medical services’’. TI T LEV—PA I NC A R E SEC. 5 0 1 . COMPREHENSIVE POLICY ON PAIN MANAGEMENT. (a) COMPREHENSIVE POLIC YR E QU IRED.— N ot later than O ctober 1, 2009, the Secretary of Veterans Affairs shall develop and imple- ment a comprehensive policy on the management of pain experi- enced by veterans enrolled for health care services provided by the Department of Veterans Affairs. (b) SCOPE OF POLICY.—The policy re q uired by subsection (a) shall cover each of the following: (1) The Department-wide management of acute and chronic pain experienced by veterans. (2) The standard of care for pain management to be used throughout the Department. (3) The consistent application of pain assessments to be used throughout the Department. (4) The assurance of prompt and appropriate pain care treatment and management by the Department, system-wide, when medically necessary. ( 5 ) Department programs of research related to acute and chronic pain suffered by veterans, including pain attributable to central and peripheral nervous system damage characteristic of in j uries incurred in modern warfare.
